Marriage in more than one state in the US now is defined as a right given to two consenting adults, despite gender or race. No state can make a law against this right; such is expressed in the constitution. It will be overturned eventually because the constitution is on our side in three major ways.

The reason why there was no vote for it, is because it has always been understood that way throughout the history of Western civ. It's what is best for society and kids. Kids need mothers and fathers and get serious emotional and psychological probs. w/o them. Still, if we allow same-sex marriage based on love, why not siblings? Why not polygamy? Polymory? Proposition 8 will be invalidated by the Supreme Court of California.
A simple majority vote (and especially such a small one) cannot eviscerate the Equal Protection Clause of the California Constitution under strict scrutiny analysis of discrimination against a suspect class.
Chief Justice Ronald George, who is up for re-election in 2010 is not afraid of being voted out of office. The other majority Justices in In Re Marriage Cases are not up for re-election for many, many years.

I passed by this rally while on business in Beverly Hills. People were out of control. Banging on cars, blocking streets, screaming at an old lady who was just passing by. Obviously a great way to win people over to your cause.

The good news, if there is any good news from this, is that the voting was strictly along age demographics.
People under 30 overwhelmingly opposed Prop 8.
People over 65 overwhelmingly supported Prop 8.
Those in between 30 and 65 were almost evenly split.
As more young people reach voting age, we will have enough votes to defeat this amendment and equal rights will be given to all.
It took African Americans about 200 years for equality. Won't take that long for gays.

It's also that the people who voted for Prop 8 were raised in the 1940s, with 1940s beliefs. At that time, segregation was still alive and well. Blacks sat in the back of the bus.
Today's kids are raised by their television set, watching Queer Eye for the Straight Guy, Third Wheel, Ellen, and many other gay-theme shows.
The young have a great deal more empathy about gay lifestyle. They don't mentally associate it with Liberachi or Rome burning, like the older crowd does.

Prop 8 wether you disagree with gay marriage or not in not constitutional, plain and simple. Marriage in more than one state in the US now is defined as a right given to two consenting adults, despite gender or race. No state can make a law against this right; such is expressed in the constitution. It will be overturned eventually because the constitution is on our side in three major ways.

Exactly- I don't get it. As an Asian-American minority, I felt compelled to vote against Prop 8 because I truly feel this proposition is a step backwards in our nation's civil rights movement. Our state constitution has never take rights away from a group of people, but with the passing of this prop, we might be faced to do so.
Keep fighting! Prop 8 is just a bump in the road. I will not end our fight for equal rights for ALL.

That's quite true. Gays have the same rights of marriage as straights. They cannot marry more than 1 person and cannot marry siblings as well as members of the same sex. Hence, this is NOT an equal protection matter. Let's say same-sex marriage is permited. Two straight men or women will be able to marry each other too.

Yes, that's civil unions. It's marriage in all but official title. That's correct. Marriage isn't a right, but a privilege and they have the same rights regarding official marriages as straights. A gay man and a gay woman could marry for the sake of mutual self-interest as many straights have done. They are equal in rights to straights on this already. Let's say same-sex does get passed. Then straight men or women would be able to marry each other too.
