While I do think that Ledger deserves some honors for his great work in TDK and his other films, I think the actual award should go to the man who did the best job. I mean, if it weren't for his untimely and tragic death in January 2008, he would have had his entire career in front of him. There wouldn't be such a rush to give him the award. I guess what I am saying is that the Academy voting committee should vote as if all the nominees are alive.

It's not about emotion and the fact that he died doesn't make his chances higher than they would have been if he was still alive. Heath provided a new face for the joker, and was able to show how powerful acting can be. Emotional crap is shit, I say.
