The US Criminal code, 18 USC 2340 and 2340A do NOT make it a crime to torture those who themselves do not follow the Geneva Conventions. Here's a hypothetical for you:
If you do torture the guy in the senator's hypothetical, and he tells you what he thinks you want to hear (maybe he just doesn't know), then you're going to get the wrong information. Then you'll deploy all your resources to the wrong city (since the detainee just named one at random). This will prevent you from getting the real bomb before it explodes.

When we found him, he was apparently an American (Caucasian if I remember correctly), and I don't think he was a member of any of the groups we were going after. Since it didn't fit into the fear-the-middle-east propaganda at the time, we didn't really hear about it.

Am the author of a 2008 book on turtoure entitled The Big Book of Pain and one of the things which struck me during research was that for 3,000 years people have known torture doesn't work. With enough pain anyone will say anything they think you want to hear whether or not it is true. They just want to make the pain stop. torture is the worst way to gather information immaginable.
