Currently, there is no system in place that regulates that. There have been instances where they would keep shooting at whales and only take a few. The rest would just sink in or float away.
The problem with your logic is that without the mechanized invasion of Europeans, the animals would not be endangered to start with... and how many are being killed by indigenes would not matter. It's like the case of the manatee in Australia. The whites keep blaming the Aborigine but the only reason the thing is endangered is because it was obliterated in all its natural habitats by the whites, except for one... one where the Aborigine still hunt it for sustenance.

There a Polar Bear killed in the 19th century that was something like 5ft. 5in. high at the shoulder, 11ft. 11in. long, and weighing 2,207 lbs.
