  • Currently experiencing the same issues. These guys try to make it seems so lovely at first and act like they are going to help you save your home, but all the while they are like f-ing vultures just trying take you home right from under your feet with a smile on their face. I would love to know of any type of class action lawsuit that is in process with these people because they literally stole from me & it is now f-in up my credit!

  • This month was our 1st trial payment and after watching Coco's video I don't feel I am saving my home, I just feel we financed a mafia. We will still lose our home even if we pay? and on top of that those trial payments does not go towards our mortgage? You know what's worst.. WF knows you can't afford a lawyer if you are in this situation so they can get away with everything..We live in California and if there is any Class Action against Wells Fargo in this matter please contact us I had it.

I filed so many complaints to government agency which is just for us to feel good that something is getting done. Every agency said they can not regulate the banks.   • yep, just saw this happen with one of my clients and heard it this a.m. from an experienced real estate investor who deals with banks and preforeclosures all the time. The loan modifications are very beaucratic and a total waste of valuable time. It's much easier to let a negotiator come in and buy the property PRIOR to the foreclosure date; everybody wins; IF DONE PROPERLY, homeowner wins by avoiding TAXABLE GAINS AND A FORECLOSURE-THATS HUGE.

I worked for 3 years paying my property and I called for a refinance and they told me to apply for a modification but I have to be in default before they can help us. This is was our bank telling us to do this, why would they lie to us, now I know why there theives. They forclosed even though I had been tried every way to work it out. they are crooks and no one is doing

  • @tducksoup a damn thing about it. All I want is for a judge to look at all my paperwork and emails that show what I went through and how they just wasted my time and never intended to help us. I have filed complaints to all government agencys and to freddy mac and it fell on deaf ears. what it came down to was Wells fargo who had no vested intrest as far as the money made sure I lost it and they bought it at auction for $148k while I paid $504k They made a real good deal stealing my property.

  • WARNING; opt out of class action lawsuits. Read Wachovia approved class action; it takes away your right to sue the bank and they put NPV clauses where they can reject a modification if it is profitable for them. Attorney's made 25million-plantiffs got $200 and the 'opportunity' to modify and get a loan they should have gotten in the 1st place. These should be illegal. Another way for banks to rip you off. OPT OUT and gather a group to sue the bank. Contact your congressman and flood w/letters.

  • I'm also from California, a non judicial state. This means they need not prove standing in a court of law in order to foreclose. They just foreclose. The only way to get justice is to sue your servicer. In this case, wells fargo. Google Nelson vs wells fargo. I've joined this mass joinder lawsuit. Philip A. Kramer of Kramer and Kaslow is the lead attorney and is one of the best lawyers in the country. Fight back!!!! Investors are also suing the banks. This is the only way......

  • Stumpf is a gangster, plain and simple. Wells Fargo has a 'playbook' they use to steal people's houses. They're doing it to me right now. 1) Offer a loan modification, accepting reduced payments. 2) Count these payments as 'partial' thus creating a past due balance (in spite of the fact that the agreement supercedes the Note, IN WRITING. 3) Ruin the homeowners credit. 4) Deny modification, demand 'past due balance' (an unpayable amount not even due). 5) foreclose on the home. 6) Celebrate.

Our income was cut in haft and I reach out to Wells Fargo. 10 Months later they are offering me remod. for $10 more a more than I was paying before and extend 30 years to 40 years with only 1.2 less in interest rate. They are just shitting on us.

  • I too asked Wells Fargo to look at a remod. They have spent almost 6months and have not even told me yes or no if I can enter the trial for HAMP.

    It is because I am current on my payment that they will not answer me.

    They are not obligated to put you into loan mod program even though they accepted thetaxpayer money.

    Why are we not in a class action lawsuit to sue them for breach of promise in ducement after they promised the gov they would do HAMP in echange for funds?

  • I also have wells fargo and have dealt with exactly the problems you face. My husband had his income reduced last year and I'm a student. We were told to apply for loan mod, and got through the process. At the end they reduced our mortgage a total of $45 a month, but sadly, with the forced escrow, we would be paying $200 MORE a month!

  • Good for you for posting this ! My sister's husband passed away in Feb '10. She called about a remod. "At the time, you do not qualify because you are current. Skip three payments and then you will demonstrate a need." She did. Three months later they foreclosed on her for lack of payments. End of story.

I agree with this woman but she is like many Americans, living in candy land. She thinks Bill Reiley or Glenn Beck is going to come to her rescue, lol.   • It doesn't matter if you submit the proper materials. Banks were told to implement these programs and they didn't want to.

    Chase is one of the worst. Employees of Chase openly admitted that they are told to give applicants the run-around. The number of people who get mods is staggeringly low.

    Recently, there was a piece in the news saying close to 50% of the people trying to get into the program drop out. Do you think that they just suddenly lost interest in trying to keep their homes?

  • A friend of mine is doing some kind of audit on his lender, Chase, with requesting them to provide IRS tax documents that they would have to file for having a loan - by 30 days - if they don't respond, then he's basicaly going after some kind of contract fraud etc...to win his house/deed over free and clear! Has anyone heard of this?

    It will not work. Attorneys in Las Vegas NV have tried to use this type of scheme to force the lenders into modifying mortgages and it hasn't worked yet. It is just a bunch of bullshit that will come back to bite you in the end. And don't believe that the banks don't want to foreclose on your home. They do and they will. My mortgage company modified my loan, then sold it to another lender and they rejected the modification. I am now in foreclosure.

    I know there isn't anything we can do. I talked to an attorney today and he said that the whole loan modification is still so new that only a few people actually get help. Oh well, I will be destroying the inside of my house before I move out. Then I will file bankruptcy so they can't come after me for the deficiency. The lender will be losing money on all fees that they have to pay to process the foreclosure, then they will have to pay someone to come in and fix everything.

  • @checkers1245 I've been researching this too, and it seems there's some things that can be done, stall and/or help the process...but very few and far between. It's crazy what is happening, and the residual effects are enormous! i.e. trashing your place. Which I don't disagree with at all... It will put some good hearted contractor back to work! What stage are you in? Have you contacted FTC? Lookup on line 23 defenses against foreclosure. Vote em all out in Novemeber, and good luck to ya!

  • @checkers1245 That's exactly the position that the banks put every single homeowner they foreclose into. I hope they choke on all of the houses that they repossess and have to take huge losses when they resell.

    Personally, I hope the CEOs of these banks all have prostate glands that swell to the size of watermelons with the next year.

    A lot of foreclosed homes are not owned by banks anymore. The majority of subprime mortgages are in the hands of investors who hire loan servicing companies to do their dirty work. That is why they don't have to comply with any loan modification programs that Obama has put in place. I know Obama knows this, but he is trying to protect his image in the public eye trying to fool people into believing that he cares and is doing something. HE IT NOT! These investors are foreigners.

  • @ouluvme2 Hopefully, eventually it will. It's just going to take a big enough politician getting screwed by one of these banks him or herself in order for them to care about what's going on. Right now, this is only affecting the middle class, and no senator that I know of is in the middle class. Anybody who has gone through trying to get a modification will tell you that you are completely at the bank's mercy and they literally run you around for months and months on purpose.

  • @ouluvme2 I have of something to the affect of it the Bank doesn't not have proper deed to your house then there is nothing that they can do to kick you out. Wells Fargo and I think alot of these bank are finding loop hole by servicing the loan not the actually holder of the mortgage. I don't even know who own my loan. It had been some some many times.

  • That is exactly what happened to me with two Mortgages. At the end of 3 months as you mentioned they sent me same refusal letter and asked me to make payment for whole amount. Then I put my house for short sale after talking to WF agent. I got two offers within two weeks for the house which are more than Wellsfargo amount. Since last 5 months they did not reply to those offers and now scheduled foreclosure. I got stuck with second mortgage on my back.

    Destroy the inside of the house and then file bankruptcy so they cannot come after you for the deficiency balance. While destroying the inside of the home, do not make a lot of noise. They cannot file charges against you because they will not be able to prove that you were the person who destroyed the home. No pictures, no proof. Stick it to the bank the way they are sticking it to you.

  • I'm in the same club as you. I've been trying since 2008 to get a permanent remod. I've been denied for erroneous reasons the last one being my debts are $800 higher than my monthly income. Not true they fudged the numbers against me even though they have my paperwork. I'm only $300 behind I'm now applying for the 8th time. They also broke the law by threatening me while on a forbearance agreement. I will sign a class suit action if you get one drawed up contact me if your interested.

    i submited all request document Nov 09 and evryweek i make a phone call to follow up, each time i call they give me different information. its now 2010 still being review. WF is not willing to help. they just want to pocket the money. i hope thing go well 4 u and ur family, good luck.

  • I'm so sorry about your house. I will pray for your family. My husband and I are losing our house March 16,2010. Our loan company is Litton loans out texas. We claimed bankrupcy on our credit cards and keeped the house and car loans. Becuse of my husband's wages lost. We are now losing our house because of a similar empty primoses.
