If the Federation cared at all about their people's lives they would just give them that. You do whatever you have to to survive. Who even decides what war crimes are?, the victors. The Federal Forces and Zeon were both just out their trying to control the same thing, space. @SanderRX Char had a vendetta but condoned the war. He, like his dad believed in Spacenoid Independence. Amuro and Char disagreed with who was in power. That is true but Kycilia would have been a fine leader if she had any battle sense whatsoever. Gihren was always the problem. Even Degwin, his own father, tried to undermine him and negotiate peace after Solomon. That is what Amuro is talking about. I don't think he even knew Gihren was dead until after the finale.
@SanderRX Don't forget Char becomes head of a new Neo Zeon movement in Char's Counterattack. He wants independence. And to achieve it he believes the people still on the earth must join the rest of humanity in space. After his speech at Dakar is a failure in Zeta Gundam he comes to the conclusion that the only thing that will drive the last of humanity off of their earthly cradle is making the planet uninhabitable for people in turn forcing them off so the last of our species can evolve.
