  • Atos' website claims it regularly assesses its staff through observations/consultations with stakeholders but no mention is made of giviing claimants the opportunity to evaluate its staff. The simple fact that claimants are not deemed worthy of having an opinion that counts speaks volumes.

  • Dr oluwaler - bunkagas told me my withered arm was bad and I'd score on the ESA medical. Despite this I work 12 hour shifts stacking shelves!     I was expecting too much that the Tories would have put a stop to New Labour's selling-out of the disabled (Atos were brought in in 2005) - seeing that the Tories have extended Atos' contract to 2014.

    As to your own story, as far as this administration goes (and the previous one), Atos' word counts for far more than someone with actual medical knowledge. Surgeons? Professors? Leaders of their field? Why, Atos' half-trained midwives know better!

  • im still waiting for my appeal hearing, atos dont seem to give a toss (ATOS) scored "0" at my assessment, got 4 doctors and 1 psychiatrist backing me against an untrained atos employee with no previous medical or psychiatric training, this country is a sorry state of affairs.

    Appeal it, and get what medical evidence you can - your doctors and specialists will be able to help on that one. If they know about the Atos problem and are willing to speak up on your behalf, so much the better.

    Also, next time you get called in for assessment (it will happen), make sure you audio-record the session secretly, and then that gives you more weight to contest their 'findings'.

  • I applied for a paper hearing as i couldnt guarantee my health on the day....it was adjourned in july 2010.

    Heard nothing back...and got told i HAD to go and see ATOS again!!! I got 0 points this time too!!!

    Didn't read this comment before I responded to the other one on the other clip. Appeal it again. Unfortunately, the screwed-up nature means that the appeal process will start off all over again.

    But yes, it seems that even if you're appealing a previous decision, they can still call you in. It's not a process that the tribunals service are happy with, and rightly so, because the system is an absolute mess.

    Im appealing this one too...such a pain in the arse. I swear they do it so you give up and just do what they want ie jump on JSA.

    Im confused now because il have 2 tribunals...if the first one from last year refuses my claim and the one from this year accepts it...then what lol??

    I suppose il have to wait until next year to find out though haha

    Yep, forcing people to go onto JSA is exactly what they're up to, because it's easier for them to manipulate people that way (ie. 'jump to our tune or we'll kick you off even that').

    In answer to your question, it may be best not to pursue the first tribunal any longer, in case it has a knock-on effect on the second.

  • Actually, our PM doesn't run our country, clealy, because Brown never liked Freud, but he was inserted into DWP anyway. Cameron, being more ruthless and dangerously insane always like Freud, so as soon as he was in power, Cameron powered up Freud, made him a Lord and hid him in the House of Lords, opposite a heroin in our lifetime, Baroness Campbell of Surbiton. A crime in itself.

  • after a 9 month battle with the DWP and ATOS, you now can ask them to record your medical for you. it's free and you get a copy of the tape as you leave. keep it safe as what the doctor says on it might not be on the report he does.

    Nobody's as sick as Atos. Even by the notoriously callous nature expected of government departments, Atos' relationship with the DWP hits a new low.

    The body of a missing woman (Leanne Chambers) who suffered from depression has just been found.

    She went missing shortly after an Atos assessment and her inevitable 'You're fit to work' letter. I believe that Atos and the DWP share joint responsibility in her death, and both should be facing criminal charges as a result.

  • ATOS has just scored me NIL. I was reviewed not by a doctor but by a nurse, i am on crutches due to an aggressive form of Rheumatoid Arthritis, I am in constant pain & my ESA stopped. My GP and my consultant have told me I am not fit for work. As well as pain and stiffness I suffer from chronic fatigue which is a classic symptom of Rheumatoid Arthritis. This ATOS organisation is evil, they are making money out of genuinely ill people. How the hell can a nurse know more than my RA consultant ?

  • @LloydsTSBLiars cont 2/ Bar a miraculous cure for RA I will always be limited for kind of work I can do but hopeful in that I can find something suitable as I feel I want to contribute to society in some way. Since yesterdays comment I have had time to re-read their medical statement. The errors & contradictions on the report are incredible, even the eleven different drugs that I am on have 4 mistakes re the dosage levels supplied. Also remarks on my physical ability to do certain tasks are lies

    "How the hell can a nurse know more than my RA consultant?" - A nurse can't, and an appeal tribunal will see it the same way. You have a good chance to get the decision overturned and once you do, make a complaint to the General Medical Council about the person who assessed you.

What has irked me so much is that I am genuinely disabled and have until recently been extremly ill ( not being able to get dressed my self level ect, of illness ) I have told my GP that in fact I do want t start some work as I have never been a scrounger, but advised to start doing a few hours charity work first ( Citizens Advice ) the part time paid.

I hate to mention 'medicine' and 'Atos' in the same sentence.

I feel so incensed by the the fact that I have no restrictions. I dearly wish I had no restrictions, health wise I have been through hell not to mention the financial burden I have had to endure. I hope the government & Atos read this site, surely at least some of them must have a concious ? Benefit cheats are 1 thing, targeting sick people is contemptuous

    The other week, there was a Radio 4 debate with Digby (aka – ‘the most expensive member of the Lords’) Jones, Chris Grayling and Rosie Winterton.

    All of them were in favour at putting the boot into claimants, and all of them were previously exposed as grasping, greedy, hypocritical cunts in the expenses scandal.

    Shouldn't you be getting paid at the same rate until the appeal is heard? I'd be asking about that one.

    My other point is 'incentivising' is not the same thing as 'forcing'.  Maybe it's too much to expect that the DWP, the government and Atos would also know the difference.

  • @LloydsTSBLiars Well the last time I was on the basic rate then got the rigged medical, and stayed on the basic until I won my appeal so I hope you are right. If thats the case I needn't worry so much.

    It doesn't stop it all being a bit shifty scam. Its benefit fraud in reverse really.

    Still, they've already instigated the suicide deaths of two people with the WCA format, so I suppose money grabbing is small fry compared with that!

  • @Thoughtland Have seen ny GP since my last update, he hit the roof and is writing to the DWP. Apparently they do not give the GPs the full report, fortunately I took mine in & left it with him. I have also written appealing directly myself. I have been pretty blunt but polite & made direct accusations against the nurse for unprofessional practice, much of which I can fortunately prove. I have taken other courses of action which I do not want to mention until its over. Will update later.

    Google 'consumeractiongroup ATOS FOI request' for more on that, and what the DWP's take on this is, as regards doctors or specialists.

    It's a standard, pre-drafted response letter, but prepare to shake your head in despair before you read that.

Fortunately in my case some serious mistakes were documented and often contradictory ie 1 page said 1 thing & another page completely stated the opposite, making the nurse assor look pretty stupid. I have a recognised and complex health problem that beggars belief that a nurse would have the in-depth knowledge to fully understand. Take care

    Look online in relation to a Commons speech given by Jonathan Shaw, and you'll notice that huge chunks of that letter are lifted ad verbatim from his speech.

    So, the DWP don't even bother to think up responses for themselves these days. I wondered for a while what large sections of the DWP are actually there for. Nothing, it would seem.

    One bit of comedy gold in that letter is 'the HCP will be aware of the law relating to benefit entitlement'.

    Most of the DWP aren't aware of the laws relating to benefit entitlement, which is why call jockeys will given you contradictory answers every time you phone up.

    Besides, a HCP that knows better than multiple GPs and specialists AND most of the DWP?

    Multi-talented fucker, isn't he?

    And if he's that talented, why's he working for pissants like Atos?

    Thanks for the kind words, but the volume couldn't be helped. This was recorded on a mobile, so the quality of the recording goes up and down all the time, and couldn't really be avoided.

  • Many thanks for this video. I too have had to go through this charade, which took 9 months of hell to appeal to be overturned on proper medical evidence without even the need for me to attend. Even after appeal nightmare was not over was sent back to atos. I dread having to go through same yet again and pray that I can get my health sorted before I have to go through this hell all over again.

    I was so upset by my treatment that I provided written evidence to the Parliamentary Inquiry

    and I published all my correspondence, including the unsound medical report and extracts from the Contract between then DWP and Atos including those medical conditions where a face to face assessment is not necessary. It is coming up to a year and there is no end in site. Judge for yourselves look in the search sites for DWP ESA ATOS.

    IF Atos does occupational health for a company you may want a job with, under instructions from the company (if the applicant has a medical history), Atos will deem you unfit.

    Even if they said exactly the opposite when they dealt with the same patient in an ESA case!

I've had the displeasure of having to go for a so called medical with this corrupt organisation, and what you say echoes the horror stories posted on many disability forums all over the internet. I've also heard that many of these 'doctors' aren't even GMC registered as many are retired/have been struck off due to malpractice/incompetence. The sooner the whistle is blown on these heartless bastards, the better.

    No-one else seemed to have posted anything else on Youtube in opposition to Atos, so I thought that the first might as well be me.

    I notice that Atos' own promotional clips on Youtube have to be administrator-approved for comments.

    Nice to see that they take such a listening approach to criticism. Then again, I suppose they're only adopting the government's tactic of 'close our eyes and ears to anything we don't want to hear or see'.

  • @tb1uk Whilst I fully agree with what you say one must further analyse the options available to the atos doctor as Medical reports are clearly made up of answers to multi choice answers.Atos's core business being in IT they may feel that humans health can be assessed in the same manner.The compiled the multi choice answers and I requested a copy of the data used. William Hills will not even offer me even money on the availabe options being biased towards failure on assessment.

  • ATOS will tell you that LIMA (the multi-choice system in question) is a DWP system, and that the DWP hold all contractual rights.

    If that's true, and as the DWP are a government body, then the DWP would be breaking the law by avoiding questions about LIMA. So, any excuses about the workings of LIMA being 'commercially sensitive' do not hold water.

    However, the DWP are not above buck-passing - as I know all too well.

  • One should not continue with an appeal if they fail to provide a copy of LIMA.You can challege the lawfulness under the " Disclosure of Evidence " legislation as LIMA is a source of evidence. It equates to evidence being presented in a language that you do not understand as all info on the medical report is LIMA generated.
