Well, you can download DSiWare, Virtual Console games and special 3DS software in the eShop.

Most of these do cost a bit of money, although some are free.

But if you mean illegally downloading retail software, 3DS games have, so far, not been hacked (take that, filthy pirates! >:D)

If you want the retail games you will have to get them the way you're supposed to get them: by buying them.
