If the boy was diagnosed with Asperger's that very day, then people would've been aware of his uniqueness for quite some time, indeed it's probable that a school psychologist took note of the possibility. It's pretty easy to pick up on someone who has autism regardless of being aware of his or her diagnosis. Nonetheless, I can't see proper justification for disciplining someone acting in such a way, much less making the entire class turn against an already socially uncomfortable child.

I was the only one who got punished: a week of isolated lunch. I got nothing for that "injustice." I got over it the next week. Damn...if I lived in today's school, I would've gotten more than $350K.
Anything up to $1000 seems like a fair amount to me. Any more than that, and I'm totally on the side of the school. 350k?! FREAKING RIDICULOUS. This is why America is in so much debt.

There were situations where the teacher(not always the same one) would ask the class if we wanted the student to leave or not and the majority of the time we decided, as a class, that the student should leave. But we didn't hate the kid for it.
It is never acceptable to involve other children in the discipline of a child, luckily this practice is getting rarer but it do still happen. Bullying is such a huge problem and when teachers do things like that that enforces bullying. The teacher was definitely in the wrong here. Now I have Aspergers I can sympathize with this little boy, however 350 000 dollars are allot of money. I think the teacher should be made to apologize to the boy instead of the school paying out allot of money.

There was no lawsuit. The district settled for $350k! That's a big red flag. Think about that. Why would they settle for $350k unless there was a lot more of this sort of thing going on? If the district had nothing to hide, they would have taken this to civil court.

In kindergarten I had to go from green to yellow for snatching MY backpack out of another kid's hand. And on another day when I had had my finger smashed in a car door and I couldn't do the hand movements for the PTA show that week the teacher made me sit in time out. How much am I owed?

Well, I'm not sure how either one of us would go about trying to objectively quantify what's fair in dollar terms. It's pretty subjective. Without a clear statute, I'm not sure if they could either. I happen to think it's a good settlement. And anyway, this settled out of court, so it's perfectly fair by definition.

When I went to elementary school 30+ years ago, they used to put diapers on the kids who would get wet playing in the water in the fields in the Spring. No joke. I think that would leave a lasting scar on them. Whether it scarred them for life, I have no idea. But, I still remember certain things that happened to me in elementary school. Specific things. They haven't wrecked my life but when I think of them they bother me. So, if I had to take a side I would side with the parents here.

I have aspergers and the name did not exactly help with the bullying. I used to joke about it to keep the bullies at bay saying things like "eat my ass burgers" People have a frame of reference when talking about autism. People understand mild autism better than aspergers

I can wholly believe you had to deal with extra bullying because of it and that is EXACTLY what I am talking about. I know how most illness gets named and the traditions but sometimes you need to use some sense as well.
I've worked with kids with Asperger's, and it is almost impossible to keep your cool sometimes. If you're lucky, the kid will just be socially awkward, but in a lot of cases, basic social norms like stealing, swearing, hitting, and lying break down in the child's mind. I don't blame the teacher, given that he/she didn't even know about this condition. And the vote was probably more to get a sense of what the class felt about the boy, not to actually decide his punishment.

That teacher is a moron. I work with children and it is blazingly obvious which ones have special issues, even if you don't know exactly what developmental or learning disability they have. It should have been the school's responsibility to recognize his special needs.
Second, kids with autism disorders don't get over things the way a normal child would, because the DON'T understanding how their behavior affects other people.
This kid's rights were violated. He has a right to an education. Leave the Asperger out of it, and still when would it be appropriate for a teacher to do what she did. If you want to remove a child from your class, there are more appropriate channels to go through. Publicly humiliating the child isn't even remotely necessary - and it teaches what? I have an Asperger child, and when he started having trouble in school, counselors approached us to help him be diagnosed.

There were situations where the teacher(not always the same one) would ask the class if we wanted the student to leave or not and the majority of the time we decided, as a class, that the student should leave. But we didn't hate the kid for it.

It is never acceptable to involve other children in the discipline of a child, luckily this practice is getting rarer but it do still happen. Bullying is such a huge problem and when teachers do things like that that enforces bullying. The teacher was definitely in the wrong here. Now I have Aspergers I can sympathize with this little boy, however 350 000 dollars are allot of money. I think the teacher should be made to apologize to the boy instead of the school paying out allot of money.

There was no lawsuit. The district settled for $350k! That's a big red flag. Think about that. Why would they settle for $350k unless there was a lot more of this sort of thing going on? If the district had nothing to hide, they would have taken this to civil court.
When you settle the details are not disclosed. If it goes to trial its public record. What does that tell us? (hush money)
Complain about the money, all you want, but that's what the school district CHOSE to settle for!

I think a proper settlement would have looked like the boy gets lets say 15.000 $ in compensation for his pain, and the person who made the decision to put the poor child through this fascist-style treatment gets thrown in jail for 6-9 months, which would be plenty of time to think about if being the biggest asshole in the room is a good thing to do. It is less about PROPERTY here, and more about PRINCIPLES. How does a perpetrator ever get it, if other people are to pay for his fine?

It's a difference of brain functioning, most people who have it have higher than average IQ's. They did overdiagnose ADD in the 90's but many people have that as well. I agree with what you said about Cenk, But the fact remains, teacher taught a "life lesson" to the child's fellow students, when the fact is that the teacher was incompetent, and disciplined a student with a disability, which is contrary to a United Nations edict for People with Disabilities. The teacher could not make a competent diagnosis and behaved poorly. 350K is WAY too low when you mess around with a disabled child's entire life!

Later that year I saw a 7th grader with autism being dragged by the neck and I told my principal. I was disciplined for using the students first name in an e-mail? petty bureaucracy. They were terrified about another lawsuit. I regret not telling the mom. I quit a job I cared about.

When the staff found out that I "ratted out" a special ed teacher. Their anger confused me. I was just helping a kid. I wasn't sure what was "right" . They threatened to transfer me to a school of 1500+ students. I had just left a job like that. to much social interaction for me! I left Racine w/ regret

Well, I'm not sure how either one of us would go about trying to objectively quantify what's fair in dollar terms. It's pretty subjective. Without a clear statute, I'm not sure if they could either. I happen to think it's a good settlement. And anyway, this settled out of court, so it's perfectly fair by definition.

Wow! THIS is a controversy? When I was a kid in catholic school the teachers would literally beat your head against the desk and smack the shit out of us for even the slightest mistake on a paper! Where was all the fucking media outrage then? No one thought to sue the school. This kid was NOT victimized. He'll be fine. But there were "crazy" kids in the class that no amount of hitting or humiliating would tame them. They'd run around screaming and hitting others. To us they were "bad kids". Wtf? My 1st grade teacher voted on whether or not to put me in my own "group" (there were about 4 or 5 making up the entire class), and I don't even have aspurgers. The teacher went on about how I thought I had "a lot of power over all of you" meaning the class. Bonus points for the fact that I was the only kid who went into that class knowing how to read.

Two things;
- Kids voting to kick out other kids is not acceptable. Not only is the teacher at major fault for doing this, but most likely it happened because he was 'different' in the first place. Unacceptable.

It's not that he was sent to the principal's office, it's that the teacher had the other students vote. At his age that can be very damaging. And while they didn't know he had Asperger Syndrome, it probably had to do with him being "different" and the teacher being someone not willing to deal with that. In any case, I'm sure there are a lot of details we're not hearing in this story.

When I went to elementary school 30+ years ago, they used to put diapers on the kids who would get wet playing in the water in the fields in the Spring. No joke. I think that would leave a lasting scar on them. Whether it scarred them for life, I have no idea. But, I still remember certain things that happened to me in elementary school. Specific things. They haven't wrecked my life but when I think of them they bother me. So, if I had to take a side I would side with the parents here.

You'll be pleased to know that it has been changed in medical practice. It is now considered an autism spectrum disorder or mild autism. It was originally named for the German guy who discovered it. Hans Asperger.
I have aspergers and the name did not exactly help with the bullying. I used to joke about it to keep the bullies at bay saying things like "eat my ass burgers" People have a frame of reference when talking about autism. People understand mild autism better than aspergers

I've worked with kids with Asperger's, and it is almost impossible to keep your cool sometimes. If you're lucky, the kid will just be socially awkward, but in a lot of cases, basic social norms like stealing, swearing, hitting, and lying break down in the child's mind. I don't blame the teacher, given that he/she didn't even know about this condition. And the vote was probably more to get a sense of what the class felt about the boy, not to actually decide his punishment.

That teacher is a moron. I work with children and it is blazingly obvious which ones have special issues, even if you don't know exactly what developmental or learning disability they have. It should have been the school's responsibility to recognize his special needs.
Second, kids with autism disorders don't get over things the way a normal child would, because the DON'T understanding how their behavior affects other people.

This kid's rights were violated. He has a right to an education. Leave the Asperger out of it, and still when would it be appropriate for a teacher to do what she did. If you want to remove a child from your class, there are more appropriate channels to go through. Publicly humiliating the child isn't even remotely necessary - and it teaches what? I have an Asperger child, and when he started having trouble in school, counselors approached us to help him be diagnosed.

This what happens if people use emotions instead of fine sense of judgment in courts. We all should agree that if an individual hurt others, he should be punished for his own actions. In this case, they punished the entire nation by paying the the kid! from public's money!

I got paddled in front of the class a few times. That should be worth more than $350K. Make me a millionaire for it. Once, a small group of us were goofing off instead of finishing an assignment. The worst part was that I got one more whack than everybody else.

I'm gonna disagree with Cenk on this one. That school got what it deserves. If it can't keep there teachers in line, then who knows what else they could do. I mean isn't a school suppose to help kids?!

What the flick? In the case of the outing of a female student, you guys (TYT) were all for suing the school system. Apparently I was the bad guy in that case because I said that it would only serve to harm the education of the other students.

Is Anna against democracy? Such votes would be no problem in Denmark. The teacher want the other students to judge whether the get enough out of the class or if the kid is to much. Would not happen often, but in extremely bad cases.

I'm not saying that USA isn't civilized, simply that you should come up with something to support your claim. I also said, that this is not something done regularly, however the teacher chooses what he/she finds to be the best course of action.

See to me there is more to the story that's being revealed. Personally i think the teacher liked to pick on that poor kid. On top of that i bet she let the other students harrass him as well or encouraged it cause he was different. It seems odd the school would "settle" for just this one explanation. I believe it was much more than that. I side with the parent if that's the case. Bullying can leave scars on children even at a young age.
