Honestly, The Judge should have stopped the proceedings on the defendant and released him and thrown out all the evidence against him and had the prosecution start from scratch! All the evidence brought to court since the hiring and all cases where that deputy was present all be overturned. It will never happen again, I guarantee it!

The judge ordered him to make a public apology to the defense attorney or go to jail. Arpaio said fat chance (Big Surprise) of an apology. The judge then found him in contempt for refusing the order, and eventually he turned himself in. I believe he spent one night in jail. So, in typical fashion, Arpaio puts himself & his deputies above the law yet again, rather than admit to wrongdoing. Also, the deputy never was able to fully explain his motive in taking the document so it remains a mystery.

Simply a court deputy or any officer of the court cannot view any defense or prosecution documents unless otherwised instructed to by the attorney holding the specific document or the judge. As an attorney you should always be aware, even if in the middle of presenting a case, of whether or not materials are being taken from your table. With that much play so close behind me I would have ask the judge to instruct the officer to move.
Judges and cops should be in jail and all criminals should replace them in their respective roles.

Arpaio's Sheriff's Department is a royal piece of shit.
The guy tried to arrest the director of the Village Voice here in NYC because they have a subidiary out there. He fucked up. You may not get burned right away, but burned you will be. They are not connected. They simply know waaaay too many people that tell them things and they exposed the crooked politicians.

The defense attorney should file a complaint against the police officer and the judge. The police (who is part of the state) has no right to see the defense's evidence.

Court officers are allowed to screen confidential files to make sure that they don't contain contraband, like knives, cash, etc. but officers aren't permitted to read them.
Maricopa County's Sheriff Office is corrupt. Sheriff Joe Arpaio has been using his power to spy on opponents, and even arrest New York Times journalists who have been critical of him. Arpaio and the Sheriff's Office are reportedly being investigated by the FBI.

That Sheriff Joe is a moron, how he ever decided the best way to run a jail is by treating the prisonners like animals is beyond me.
It's not about people not serving their debt to society, but they need to be given a chance to learn a trade and reform, so when they come out maybe they wont go back to commiting crimes.

Simply a court deputy or any officer of the court cannot view any defense or prosecution documents unless otherwised instructed to by the attorney holding the specific document or the judge. As an attorney you should always be aware, even if in the middle of presenting a case, of whether or not materials are being taken from your table. With that much play so close behind me I would have ask the judge to instruct the officer to move.
