Those sobriety tests are more of a technicality than anything else. In court officer's are asked whether they did the tests but they already know from the physical characteristics of someone under the influence. Furthermore it doesn't matter if someone blows a .08 or above or passes the tests if they were still seen by the officer driving in a manner that could be described as impaired. It doesn't mater if a drunk can do backflips once out of the car if he still drives like a drunk.

He was swaying back and forth, he kept moving his feet when the officer told him not to, all that shows a lack of judgement, I wouldn't want to be in the 30% he screwed up on.People need to realize they wil lbe held accountable for their actions, you decide to drink and drive, then your happy ass should go to jail!!

I don't condone drunk driving by any stretch, but it sure seemed like Mr. Chamberlain was still pretty coherent. He stood on one leg about 18 seconds longer than I would be able to sober, but as they say, "Over the Limit, Under Arrest". Kudos to the NSP trooper for not cutting him a break.
