  • If the health care law is repealed, then insurance companies can (and will) continue to practice recission, meaning they can deny or drop your coverage if you have a pre-existing condition. Anyone who thinks repealing the health care law needs to think long and hard about this aspect of it.

  • My state is helping to fight against this bill, too. This bill violates the Constitution by forcing all Americans to buy a private product. I'm about to go into college, and I'm not about to lose hard-earned money because the IRS wants be to buy something from them. MA's hospitals are already going bankrupt under this system.

    If the states win the lawsuit, the bill hopefully be as harmful as it was first written out.

  • I know it doesn't help you feel any better, but the citizenry is less racist and better educated now as compared to the way it was when I was a child. As a child, I attended segregated schools. One wing of the school was set aside for African-Americans, and we met only on the playground or sometimes at lunch. When token desegregation arrived in my high school years, one black student joined my class for gym. I know that much change is still required; that is true in Chicago as well.

  • While it is rarely used to justified legislation these days as the Commerce Clause is more applicable, I urge you to examine Article I, Section 8 of the Constitution. It explicitly gives Congress the power to "provide for "the general Welfare of the United States"

    Furthermore, I'm sure a Constitutional scholar such as yourself is fully aware of the Supremacy Clause of Article VI and surely realizes nothing in the 10th Amendment diminishes its meaning

Recently, I have become to tire of self-appointed experts who assert knowledge of how the Framers intended us to interpret the Constitution while pointing to some provisions - The 10th Amendment in this case - while ignoring other, more relevant passages. I, like every other individual who graduated from a US law school, learned the folly and dangers of such efforts.

  • I make no claims of being a constitutional scholar; I am well aware of the limits to my knowledge. However, I do know and read the writings of individuals who are constitutional scholars, and I am yet to hear the most conservative of the lot (I follow the opinions of both moderate and conservative jurors), and I am yet to find one who opposes the legislation on constitutional grounds. There may be some, but they've escaped my notice. (continued)

  • Let me add a tip I was taught by constitutional scholars who argued precedent-making cases before the Supreme Court - when someone argues for state nullification of a federal law, they know less about the Constitution than the average first year law or history student.

There's an excellent new book out called The Framing of the Court. The book deals with a history of judicial review and its abuses by conservative Courts throughout US history. I suspect you will enjoy it.
