we have recussed about 10 judges in one county so far... one of them left the department after setting a trial then going on vacation and handing off the trial to a commissioner, then another judge, who held a trial in my absentia/ was handed a foot deep file, and in ten minutes had , put 2 witnesses on the stand who both lied, and granted possession of my home to the bank without ever even glancing at the nearly 2 foot thick documents I had filed in opposition..I motioned to vacate and rucused

Personally, I think judges should be judged at least semi-annually by the communities they serve. Not an election, but a fully comprehensive gathering of community interest and judges. Might knock some of the more pompous ones (like the one's who think of themselves *as* the "Court") back where they belong: In SERVICE to their community. Same for DA's, only, they should be reporting monthly to us.

I hate to be the bearer of bad news, but the judge didn't do anything wrong by not hearing the Constitutional arguments for two reasons:

(1) Issues of law are reviewed de novo on appeal

Unlike factual findings, an appeal judge who reaches a different outcome on how the law (not the facts) ought to be interpreted can simply ignore the lower judges findings (thats what de novo means).

(2) The judge thinks your attorney's arguments fail the "straight-face" test.

This means that the argument is far-fetched enough, that the judge can't keep a straight face when evaluating it. Now I agree, that her courtroom demeanor could have been less condescending, but 14th amendment arguments are REALLY unlikely to succeed. The two applicable 14th amendment challenges in the video are (1) Procedural Due Process and (2) Substantive Due Process

This 14th amendment challenge basically states that before the govt. intentionally takes life, liberty, or property, they must give (1) Notice; and (2) An opportunity to confront. I was at trial once for a DUI charge of which I was most certainly innocent. After a continuance because the Trooper couldn't make the court date I proceeded to aquire council. I found I couldn't afford those legal mafia types so upon next court hearing I asked for a continuance for my behalf and stated I needed council and was DENIED! COUNCIL! and Judge stated matter of factly "I'm not granting continuance, we're trying this case today".

I represented myself. I called my witnesses - grown adults, not my "peers" that were at the place I was at who stated under oath that I had not had anything to drink PRIOR to my incident that it was upon my return that I began consuming and was arrested about 1 hour after returning to the scene and started drinking. The Judge called me a liar, called my witnesses testimony a lie and "consoled me" by handing me the lightest sentence he could for my 1 and only ever "DUI".
