Mitch, join the Thieves Guild and they can take care of the bounty you got in Solitude & Whiterun. That'll let you hold on to your stolen goods (namely the hammer you use all the time).

Also, try picking up Two-Handed Orcish or higher tier weapons. They might appear weaker than your hammer, but that's because you upgraded the hammer. If you upgrade the higher tier weapons, they'll do way more damage than the Dwarven Warhammer.
