the devil gene is not really transmitted through birth because jinpachi got his when he died but kazuya got his when henhachi through him over a cliff and jin got his when the devil came out of kazuya when her was burning and tried to attack jun but she defeated him then when jin was older the devil put the tattoo on him

actually the devil gene WAS passed on from Kazuya to Jin. The devil who gave Kazuya the gene also gave Jin the tattoo. Jinpachi got his AFTER the Honmaru incident when Kazuya tried to extract Jins devil gene. Remenents of that gene forced themselves onto Jinpachi and hence he gained the devil gene and was resurected.
