im a bit confused. im from central California. my dad and mom were born in California. but every one else in my family came from the south,Oklahoma,Texas, and Missouri.22 men on my dads side fought for the south,13 men on my moms side fought for the south. i have a huge confederate flag in my living room. are you trying to say that there is something wrong with this flag? because i would die for this flag and what it represents. i have shot "at" people who try to take it down.
Well the reason is probably because fewer people would complain about flying it there, or maybe because it marks a historical site that has something to do with the war itself, or maybe there is a cemetery there.

@CymHastings Also don't you believe the SCOTUS has made wrong decisions before? Dred Scott? Plessy v Ferguson? Roe v Wade? The fact that SCOTUS is political means we need another check, and that's the states. Nullification and Secession are not prohibited in the Constitution, which under the 10th Amendment means states are free to do it. Also secession is not a rebellion, it's leaving. What Lincoln did was treason. See Article 3 section 3. War against any state is treason.

Some yahoo YouTube commenter does not have the ability to arbitrarily do away with 200+ years of laws, rulings and precedent because it does not jive with his personal interpretation. And AGAIN, secession, which is not constitutionally permitted, IS rebellion.

If you look at what Jefferson, Samuel Adams, etc. said states would not have agreed to this. Secession and nullification are not prohibited by the Constitution. The 10th Amendment says powers such as these "...are reserved to the States respectively, or to the people." This is the ultimate check and balance on the fed gov. Lee was right, Lincoln wasn't.

@DoNotTreadOnME2012 I'm saying that if someone doesn't agree with all three branches of the Federal government, then it's probably not the Federal government that is wrong. The writings of Jefferson, S. Adams et al, while influential, are NOT law. Furthermore, Amendment X gives states the powers to legislate in matters not given to the Federal government (policing, etc); it does NOT give them the ability to create new rights that supersede the supremacy of the USCON and its government.

Either way what I'm saying is not that states can make new rights, but they can rescind their ratification off the Constitution just as they have (legally upheld) with amendments. Just like the SCOTUS gave itself the right to declare legislation un-Constitutional, states have the right to do this unilaterally within their own borders, or the whole US with a majority of states. If all else fails then secession!

Again, SCOTUS is a constitutional body; you and those who support your radical theories on nullification are not. The Constitution clearly delineates how a state can join the union; it says nothing about secession. It clearly describes the process to amendment the USCON; it says nothing about nullification. I think the intent of the founders is quite clear.

Lincoln considered the South part of the United States, which makes invading, attacking, and destroying those states treasonous and an act of insurrection against those states. I'm not saying what John Wilkes Booth did was right, but when you play with fire to tend to get burned. Lincoln had the blood of 160,000 thousand dead Americans on his hands, while Booth only had 1.

@DoNotTreadOnME2012 The constitution provides that the President shall lead the military and "take care that the laws be faithfully executed". Therefore, a state or states in open rebellion are subject to intervention by the US military under the authority of the commander-in-chief. Much like Washington led troops against those of the Whiskey Rebellion, Lincoln had a constitutional obligation to make the integrity of and order within the Republic. It was not war; it was suppression of rebellion.

@XpressForumsClick No it is true, before Lincon made the war about slavery and tricked Europe Britain helped the South in battles to get back at the North for attacks on "British North America" (Canada).
Britain was Canada at that time so near all of the troops that helped the South were from Upper Canada (Ontario)

I've also lived in the South for many years, and i know that very few Canadians have any sympathy, or even knowledge of the South.

Well the reason is probably because fewer people would complain about flying it there, or maybe because it marks a historical site that has something to do with the war itself, or maybe there is a cemetery there.

It was just so random to an outsider, it seriously looked like there was nothing for milessss and then someone was like "I think I'll put a lag here." haha.
