  • Rider was lucky he wasn't in my state. Hitting someone from behind makes it your fault. Watch it frame by frame: drivers view was blocked by van (second vehicle behind), had signal on and was turned enough so the mirrors would not show the approaching bike. Rider could see turning minivan (legal by the way as was explained below) 3 vehicles back so should have been able to stop.....unless riding too fast for conditions (another violation in my state). This is why splitting isnt allowed elsewhere

  • Isn't it ironic that you were lane-splitting to save time and get out of the traffic congestion, but your accident actually made the congestion WORSE and you got severely injured because of it? No the car should not have crossed yellow. Yes it is his fault. But you DO share part of the blame here. You were going too fast and not giving yourself time to react should something like this occur. You're better off to wait in traffic just like the rest of us.

    just so you know, the carpool cross was 100% legal, because there is a solid white line inside the carpool lane, so drivers can GET OUT OF, but not INTO the carpool lane. I rode a motorcycle everyday for 2 years in the streets of L.A. i split lanes like crazy, and i used to get so mad when a car would change lanes in front of me, but the truth is, i was an idiot back then, lane splitting IS dangerous, there is a reason it's illegal in many states...

  • My advice to new riders- don't lane split faster than you can run. You exceed your reaction time/ evasion distance and end up relying on pure blind luck. And even when its no bumper to bumper traffic , a close enough lane split can spook unsuspecting drivers and can cause an accident with or without you crashing. Be road smart and can respect the road- bigger vehicles - and if nothing else then respect physics.

  • Much too fast!! Filtering is legal and the Van should not have crossed the line but motorists just do not look for bikes. It is unadvisable to filter more than 5mph faster than the traffic which in this case was virtually stationary. Had the rider been doing this he would have seen what was happening and had time to react and even give some wordly advice instead of hitting the deck. It's pointless being " right" if you are going to get hurt. The rider could have avoided this.

  • If you are lane-splitting then you need to do it at a speed where you both have time to react, and are able to judge whether a car will get over or not.

  • I'm glad you're ok and got a settlement, as the driver was clearly at fault. But I have to say, with all due respect, that if you were going a little slower, you may have had time to break.

    I commute every day like this, and let other bikes pass me. Their speed is up to them, but my rule is, If my speed will not allow enough reaction time for idiots like this, then I adjust. In this situation, I'd be doing about 7mph. I'll get there before them, and I'm lucky just to be able to keep moving.

HoW dO yOu KnOw? you ask?.. well for one his bike would have flown quite a distance and he would have been sliding AND he got a nice settlement

The van was completely in the right which I am sure you know. I ride a bike as well. I have seen this to often from those that want to split thinking every one should yield to them.   • @slowmotion4x4 There is no lane-splitting law in California. There is no law that deals with splitting, period. It's a gentle understanding between CHP and motorcyclists which has _guidelines_. It's actually no faster than 10mph than surrounding traffic, and no faster than 50 or 55mph (I forget which as I never split faster than 40 or so anyways).

    The van was 100% in the wrong for illegally crossing the double yellow lines and if you do actually ride and didn't know this, heaven help you.

    I ride a sportbike and rarely lane split, because it's illegal and so damn sketchy. When I do, I usually stick below 15 km/h.

  • You don't have to be splitting lanes to go down because of a distracted driver that should not be allowed to drive at all. 3 days ago an 83 year old women changed into my lane without checking or turn signals. Now I'm in bed with rash in my knees and a swollen ankle. My R1 is probably going to be totaled because the paint is costume airbrush made(around $3800) plus fairing damage handle bar broken etc...

Notice he it didn't seem like he did any preventative action at all? Swerve? Nope. Brake? Nope. Horn/high beam flash? Nope. His buddies all managed to stop in time which means they were either paying attention or lucky.

  • We live in a world where people break rules. We should not drive/ride assuming everyone follows them. I've learnt the hard way when someone failed to give way to me when I was on my bike. Hit the side of the car at 50mph, headbutting the windscreen and landing on the other side.

  • Assuming a vehicle won't move left over a double yellow in a traffic jam is a HUGE mistake. At that speed he had zero reaction time to avoid that person. The van driver should have been paying attention and not crossed the double yellow, but he shouldn't have been riding so fast through stopped traffic. If there are gaps, treat those as the DANGER ZONE or you risk having a douche pull into your path.

  • @kuhlka It's hard to judge exactly how traffic was moving, but it looked to me like the van driver intended to wedge his way in to traffic even though it was stopped or nearly stopped. A lot of riders it seems don't study how traffic is moving around them and adjust their riding patterns accordingly. This rider had plenty of time to react as seen in the video; he just didn't, or chose not to. He was also going too fast by the looks of it.

  • Well both has blame in my opinion. The van for an illegal move but also the rider for traveling far faster than he should have. Had he been traveling slower he would have had more reaction time and maybe could have stopped and saved the bike and an injury.

  • @gregboyds No he didnt. CA law states that a motorcycle may split traffic. It is the responsibility of car drivers to check all mirrors and look over their shoulders before merging, which I guarantee that driver did not do. I'm not a motorcycle driver because I know how many idiots there are out there.

  • me being a biker in UK so i am not familiar with laws over there but even watching the futage the first time that car was clearly intending to cross, it even looked like the indicators were on. I personally would have been scared to go past by it without slowing right down. Maybe because I have a young son at home waiting and can not afford to take risk like this.

  • @34comecome I disagree. As a motorcycle rider (and one who faced this almost exact situation), I view every accident as my fault even if it wasn't my legal fault (as in this situation). Had he made other choices (mainly regarding speed) he could've avoided the car by either breaking or emergency turning.

And yeah he could've gone slower, but trust me when you're riding through stop and go traffic, and you start feeling comfortable because you're in the diamond line for 30 minutes and you're driving less than 30mph on the freeway you tend to forget people who drive cars are usually bad drivers

    You just made my point in two ways, "yeah, he could've gone slower". Exactly. With a slower speed comes more time to stop if someone pulls out. Plus, if you're "comfortable" riding a motorcycle in traffic you're just asking to get hit because, as everyone knows, many drivers aren't paying attn.

    The minivan broke the law by pulling out when it did. The biker seemed to be going fast, as all the cars were basically at a stand-still, but he probably was going around surface street speeds.

  • @thaurgurth Just because there is no law about it does not make it legal. Its up to the officer to decide if the driver is recklessly driving. People just assume its legal, then they end up breaking other traffic laws. Semantics? Maybe, but it gets a lot of bikers out here in trouble (as seen above). 35Mph is the "understood" speed and they will pull you over for reckless driving if you exceed this! I know! The CHP is a bad example. Their cops. We all know how laws tend to bend around them.

  • @justyesful Well first of all the motorcycle was splitting traffic so even if the driver had checked his mirrors and blinds spots he still would not have seen the bike. This is why Lane Sharing is not legal in California. Its just not illegal. (look it up)

    More importantly the driver is in a "Car Pool Lane" and is NOT allowed to change lanes from there (see the double yellow lines). Not only is this a huge fine but by being an impatient dick he injured someone else in the process.
