American tax dollars are going to Law Enforcement, that means we buy their equipment (ie: video cameras in the cop cars) but when we buy our own cameras, we cant use them to video tape cops(or anything else)....that's backwards and twisted. The american people are the government. if they tape us we should be able to tape them. esp if the person is committing a crime, because in this country...where innocent before proven guilty...but that's not the mindset...tsk

Hey, why all news report teams aren't arrested when they are filming something in some city??? There are not asking a permission from everyone going past them?? Weird, soooo weird....
The police were started to protect thieves who were done wrong to people who wanted the thieves out of America. They stemmed from British army. They are not American and should be treated accordingly . Real police live in the town they serve, all others are pigs.
Fuck the police. They arrested three 6 year old girls for selling lemonade without a business license? They can go fuck themselves the religious pieces of shit wrapped in blue
How could she end with that statement when its so contradicting? What she says is proving that the law is stupid but positions it incorrectly. Its plain as daylight that an audio recording would in fact open evidence and in fact protect all involved.
so I have a consent form I am going to need everyone to fill out before you come to my sons birthday party. I plan on filming it and I would hate to be arrested and sued.
We need to protect the terrorism act cus of 9/11, cant you stupid Americans understand that? What you think its a free country or something?? They have every right to arrest your ass cus you could be a motha fucking terrorist filming stuff!
It may be illegal, but the law is unconsitutional. It is first amendment journalism. There is no expectation of privacy in public. It could be illegal if the police are plainclothes, as it becomes a safety issue.
america sucks we asia rule u bitches..u fucker big fat burger eating hillbillys are going down..ya bitches we own u ..ur leaders coming to east asian begging for business ha..get used to it fat fucks dis century is asian century
Yesterday I went "cone-ing" at McDonalds, today a police officer came at my door and said that I might have a court hearing because of it and it was a "disturbance". If I buy something, why the hell would the employee be such an asshole with no sense of humor to call the police because of the humorous way I handled the ice cream? I'll probably go to jail in a few days, because of our corrupt justice. I mean, one time some guy got jail for 8 months for throwing a piece of steak at his mom's bf.
So Police have rights that are not available to the average citizen? WHAT BULLSHIT! Police do not have rights! They have POWERS which are LIMITED by your RIGHTS!
"the police can record audio and video from their dashcam, that's ok for them". Of course it is, the law only applies to "peasants", meaning people other then cops, judges, rich celebrities, congress, and the President
un momento pro favor - "he also noticed that vang was speaking into his phone, which thought in his process was it may be an oral uh type of a communication going to the phone. um when he went over to verify that with vang he said he had been and it was just at that point he was simply arrested for the interception of communications" - esta muy nerviosa!
The Supreme court ruled "You have no reasonable expectation of privacy in public area's or property" the wire taping laws refer to phone conversations. not open and public area's.
You cops need to learn the damn law, stop being ignorant and stupid. if you can not educated yourself on or have the capacity to comprehend the law. go get a job somewhere else. where you don't endanger the public or circumvent the law!
An oral communication into a phone? REALLY?!? I didn't know you could communicate into a phone via telepathy. These cops must know something I don't. Can mutes use Sign Language to communicate through phones?
Cops don't want to be taped doing there job because when they beat or use language that isn't appropriate, or the rest of the things they do, people can actually see what it is they are doing. Lawful cops would welcome video taping, it would benefit good cops. But they are few and far between.
That's complete crap. The law is for protection of the person on the OTHER END of the conversation over a telephone. That's it. Obviously, the police and even the DA have no idea what the law is.
so it's okay for the city and police to record on dash cams and highway cameras, but it's not okay for a free citizen to record in public. Fuck this nation. The police state is getting worse every year.
What a steaming pile of B.S.!!! "It's there for the protection of everyone that is involved... so nothing is miscommunicated or misunderstood as far as oral communication as far as what's going on.." So.... having an actual visual and audio recording of an incident would somehow misrepresent what actually happened and what was said? That doesn't make any sense... It would do the exact opposite and clarify ANY misunderstanding. What is this, opposite day?
We expected this much after the wave of uncomfortable police brutality videos hit youtube.
Ok let the police fool themselves into thinking that their new law will stop people recording police and uploading. They will think they can do anything but we will be there to catch them.
HAHAHAHA lil pigs want rights too what a joke.? How about this, we will stop filming the cops as long as they stop making us by doing bad
It depends on the state as well. Some states seem to be moving in the direction of a mindless police state. I am just north of this in Washington and you simply say I am audio and video recording and according to our RCW's that is consent. I am disgusted by the direction oregon is moving in.
filming is legal filming and takeing audio with the video is ilegal thay explain it in the video but if you have a sign stateing the filming and adio is being done on premises at all times it is ligal
This country is all fucked up how the hell cant you record something that might even be helpful for evidence if something bad that might occur. I mean that is the whole idea of camcording someone just in case something did happen and you got proof.
As a lawyer, that is a horribly distorted representation of the law regarding "participation recordings".
That law only applies where those being recorded have a "reasonable expectation of privacy", which obviously does not include videoing/recording events in a public place.
Did that police officer say they stopped the recording the arrest to ensure that nothing was "miscommunicated or misunderstood"? That is the OPPOSITE to what it does.
This law needs to be challenged as unconstitutional as it is a direct and willful violation of the first amendment to the US constitution in regards to freedom of the press. In Lovell v. City of Griffin, 303 U.S. 444 (1938), Chief Justice Hughes defined the press as, "every sort of publication which affords a vehicle of information and opinion, therefore, the act of recording to share information or express opinion qualifies as PRESS and is PROTECTED. He should SUE
Personally, while this is obviously a breach of the cameraman's 1st Amendment right to Freedom of Expression, I would also go down the "obstruction of justice" avenue as well - the police are actively (and violently) suppressing/obstructing the collection of evidence.
Police can do whatever they want. They can F u up the A with a taser if they want to. It's the judge who decides whether it was legal or not. The next time a cop tries to finger your A just sit there and smile while you collect bling

Stupid pigs don't even know the law themselves. State law does not override the Constitution. Cops break the law all the time, yet they gt away with it 99 out of 100 times.
kill a cop wow thats funny wait till someone kidnaps some one close to you tortures them rapes them then kills them whos gonna help you big man your gang member cousin not happening. happened to my moms friends daughter
I would not suggest, nor endorse violence to anyone. That being said, my son was actually kidnapped/held hostage by a police officer. "We were detaining him to assure your corporation with the paper work."
I will never trust a police officer / AKA GANG member.
@kebabskallen this is a police state controlled by SS POLICE who worship there idol ADOLPH.a fool can see what is going on in our once free country we are just sitting and doing nothing as we let the police beat, murder us everyday somewhere in our own country.they are the law breakers we are the victims and we are just watching as they take more control over us everyday.we have turned into cowards afraid to say or do anything about these thugs and criminals posing as police officers my opinion.
This reinforces the notion that the U.S. wants to implement Internet 2.0. Which is where everything that is published on this 'new' Internet has to be authorised by the U.S. Government. And to think Chinese citizens thought they had problems with government censorship
Ok, as much as I love America, the POLICE DO NOT KNOW THE LAW. This is what I would have told them "It is my complete right to film this, and you can go ahead and arrest me, though I will sue your department and the city for false arrest." Fucking idiots.
@JackInBlackDawg I would have said something more along the lines of. I am recording this for a legal record of the events for my defence attorney should it be necessary to explain any discrepencies between my account and yours of what transpired here. If they continue trying to tell me to put the camera away I would tell them that there insistence on having the only record of what happened makes me suspicious that they may intend some action that they know to be wrong and that I must refuse.
The woman is such a tool. She says it's for the "protection of everyone" to arrest a man videotaping his friend's arrest? WTF. At least he wasn't interfering with the arrest. She never gave a single example of how videotaping cops makes us less safe or removes our protection! What a liar!
Americans, as the world's richest, smartest, most advanced, most intelligent, sexiest and hottest people on earth have the right to despise non americans because you are nothing when it comes to USA and you are worth a dead rat to America. We have the right to be arrogant towards you useless non american parasites who live off America's wealth
@NICKMELONMAN Don't hold your breath. He strongly supports legislation that has hundreds of pages of more government red tape. ergo more government power and less for the people. Much of such bills have already passed in Congress.
@Bureyeanne Yes but but there is always a chanse that an assassination will occur before his life changing events take place, and that would be a large dissapointment and possibly cause America and Canada to lose there political power. He better get some bullet proof glass or hes screwd.
it's public domain that is what we pay taxes for and what happens in public domain is open to be recorded both video and audio it is public property and further more they are not he Authorities they are public servant's. fuck Beaverton P.D.
@fitzgerald95971 I think what they mean by INterception of Communications that it was NOT illegal to film he was arrested for speaking on the phone about what it was that was being filmed and that giving information like that would at that point then be illegal. I think I am not familiar with the Oregon laws .
@cricketkicker59101 technically, it is illegal to record a communication between ONE or more parties without ALL parties' consent prior to recording. however, he could've easily said that he is recording a video of them, and an audio of himself, which he consented to himself :) and whatever is happening with the others, is just the background noise he can do nothing about
@Bureyeanne well, depends on the state. for example, in Illinois or California, if you want to record your phone conversation for private purposes, you still have to get every single party's consent before recording. For public purposes, you need additional releases, etc. Say, in some other states, it is fine, and you cannot profit from recorded material.
bullcrap! The audio recording of empty air is everyone's right. If he was speaking into the phone, who are they to even attempt to discern that he was picking up their voices in the background and making it illegal to record his thoughts?! Any phone call would be illegal by this definition, if its not in a sound isolation booth! Lame!
Would you like a camera shoved in your face while your working... I know I wouldn't, even more so when your a cop puting your life on the line for the little ass thats filming you, in a hostle situation like this.
When the cop asks are you recording audio the correct response is respectfully decline to answer prior to seeking counsel. This is an example of a joke law, they will always drop charges so that a conviction can never go to appeal. They will arrest you, steal the evidence and let you go. The police are nothing but thugs who are little better than the criminals
Someone should have the guts to refuse to sign for release and force a case to trial, it's a 30 day investment in constitutional freedom
@mrbonaparte THATS RIGHT , YOU ARE SSSOOO RIGHT.MOST COPS ARE GOONS AND THUGS IN UNIFORM. I BELIEVE THE WHOLE LAW WAS MADE BY CORRUPT OFFICIALS WHO DO NOT WANT EVEDENCE OF THIER CORRUPTION BRING FILMED.
@mrbonaparte Thats what I am saying. Since when did cops only have the right to all evidence of a case they are persuing. Especially if that case involves you or your family and friends....
Bull shit.. First of all, the audio recording law they are perverting has to do with settings where people presume to be in a private environment. Secondly, Cops use secret audio recordings to convict people all the fucking time... Do what I say, not what I do.

JackInBlackDawg 1 year ago

He better get some bullet proof glass or hes screwd.

fitzgerald95971 1 year ago
@fitzgerald95971 I think what they mean by INterception of Communications that it was NOT illegal to film he was arrested for speaking on the phone about what it was that was being filmed and that giving information like that would at that point then be illegal. I think I am not familiar with the Oregon laws .
cricketkicker59101 1 year ago
@cricketkicker59101 technically, it is illegal to record a communication between ONE or more parties without ALL parties' consent prior to recording. however, he could've easily said that he is recording a video of them, and an audio of himself, which he consented to himself :) and whatever is happening with the others, is just the background noise he can do nothing about
rawrrrOH 1 year ago
@rawrrrOH No it isn't. It is only illegal to profit off someone's image.
Bureyeanne 1 year ago
@Bureyeanne well, depends on the state. for example, in Illinois or California, if you want to record your phone conversation for private purposes, you still have to get every single party's consent before recording. For public purposes, you need additional releases, etc. Say, in some other states, it is fine, and you cannot profit from recorded material.
rawrrrOH 1 year ago
Can anyone say: "police state". You now live in one. Wasn't democracy nice, handing over the keys of the hen house to the foxes.

bullcrap! The audio recording of empty air is everyone's right. If he was speaking into the phone, who are they to even attempt to discern that he was picking up their voices in the background and making it illegal to record his thoughts?! Any phone call would be illegal by this definition, if its not in a sound isolation booth! Lame!

FREEDOM OF SPEECH............. IS KARL MARX RUNNING USA???
chinaownseverything 1 year ago
When the cop asks are you recording audio the correct response is respectfully decline to answer prior to seeking counsel. This is an example of a joke law, they will always drop charges so that a conviction can never go to appeal. They will arrest you, steal the evidence and let you go. The police are nothing but thugs who are little better than the criminals
Someone should have the guts to refuse to sign for release and force a case to trial, it's a 30 day investment in constitutional freedom
Zyworski 1 year ago
I agree with most people here. We should be allowed to record audio and video of police. We are paying taxes, which their income is paid from.

Bull shit.. First of all, the audio recording law they are perverting has to do with settings where people presume to be in a private environment. Secondly, Cops use secret audio recordings to convict people all the fucking time... Do what I say, not what I do.
