  • man you guys that think you can sound smart by blathering about 'blah that is a legal conclusion negligence blah' don't know what your talking about and your stupid for trying to critique one of the most successful attorneys in american history... i would explain why your wrong and teach you what i learned in the first year of tort law, but then i would be as lame as you... just stop pretending like you know what your talking about and just enjoy Mr. Spence.

  • The resident litigation experts on here who are critiquing Spence as if they have a tenth of his talent as a trial lawyer are truly freaking hilarious. Thanks for the laughs.

  • @kelley66 Except about half or more of his cross is objectionable. For instance, "negligence" is a legal standard, so asking, "are you here to convince the jury the county was not negligent" is highly objectionable as it actually requires he make a conclusion of law. There are other examples here too. So yeah, it's not that great.

  • This guy knows good and well that ANY attorney is going to go over the facts of the case before you go on trial like this. But he's gonna try and turn it around like someone going over the facts before-hand is a bad thing, implying impropriety by doing this. This asshole is precisely why people need attorneys to defend them, as people like this will do their best to trick the shit out of you REGARDLESS of the truth of the case. So long as he wins is ALL that matters to these dick wads.

It's clear that he's crossing a so-called "independent expert" hired by the defendant in this matter.  it's called exposing bias.

  • I'm sorry, but I find his "style" mannered and manipulative - the "good 'ol boy" bullshit - really repellent. If this is "classic Spence" - that is just pathetic. Watching this is a real insight into how he constructs himself as a "country lawyer" - obviously inspired by John Wayne. Soooo American.

  • It's not coaching about how to tell the truth, it's preparation for a trial. If Grisham novels are true, every witness for both sides is prepped beforehand by their lawyers. The witness should have just said it was preparation for a trial, like a baseball coach prepares you to play baseball. Plus, the lawyer went on and on about this. How was it at all relevant to the trial, seeing as every witness is coached? Did he do that same line of questioning for every witness?

    It's meant to destroy his credibility. That's about it. I'm sure that this isn't all Gerry does. He's practically undefeated when it comes to trials, so I'm sure that he has many tricks up his sleeve.

  • This man is a master litigator who has dedicated his life to making sure the common man going against the sociopolitical giants had a fighting chance at receiving justice. You cannot talk about the great legal minds of the 20th century without mentioning Gerry Spence.

  • There is nothing wrong with talking with witnesses. Spence certainly did. But Spence went far beyond prepping his witnesses: he scripted their testimony until they were little more than puppets.

    Gerry Spence spent 30 years twisting words and misleading juries, all the while wearing that ridiculous buckskin jacket. If he had been just a pompous old wind-bag, that would have been tolerable enough. But Spence cynically subverted justice to enrich himself. Such an odious man should be forgotten.

    Made me want to read everything he's ever written.

    He's a decent man right down to the core.

  • What is "amazing" "commanding" "mysterious" "mastery" etc. is one simple fact, "the truth" -- nothing can win against the truth, something that wrongdoers try to mock ET infinitum but people like Spence do not let them. God bless him.

  • I can't help feeling sorry for the schnook he's grilling. But if I were the person getting screwed by the law because of some lying schnook in court, I'd be glad indeed to see this grilling. Every trick, every word is designed to flatten out the crooked tale/tail of the prevaricating weasel in the hot chair and display it plainly for all to see. The way Spence plays dumb, head-scratching, I-just-don't-get-it, Please explain to me - it's totally Socratic.
