Except that torture is against the US Constitution and the Geneva Convention, and various other statutes.

Until they're convicted IN A COURT OF LAW, they're only suspects. After that, their punishment may include imprisonment or execution. But until they have their day in court, they need to be treated as any other prisoner. Would you like to be pulled over for speeding, be accused of being a terrorist, then tortured in a secret prison? Didn't think so.
