Sampling music is common in games. The only reason it hasn't been put on the Wii's virtual console yet is because of how badly Nintendo got burned with the US release of Earthbound. Their marketing campaign was simply awful.

Family Guy and Robot Chicken are shows that MANY people watch, so they're bound to be backed by companies who can hire better lawyers than even the record companies. They parodize pop culture, but Earthbound USES old songs, not makes fun of them. Heck, even Robot Chicken avoids using famous songs. To Japan, people would hear and see EarthBound's references to America and laugh, but America (especially the record companies) would just get all sensitive, pissed off, and sue-happy.

I honestly don't think that the parodies of music and people are what's keeping Earthbound from getting on the VC. Otherwise Robot Chicken and Family Guy would have been taken off the air years ago. We're living in an age where nobody wants to make anything BUT parodies... so to say Earthbound will run into legal issues is like saying every single parody show out there will run into legal issues.
