The phrase 'innocent until proven guilty' is a phrase that exists in American law and applies to American citizens. It's the thought of enemy combatants having or deserving the same rights as American citizens that can and does send chills down the spine of any American non-idiot. Thus, not you.

Foreign enemy combatants captured on foreign soil are neither resident non-citizens nor citizens, and have a special subset of rights narrower than either the aforementioned two groups. So it means that a citizen can kill a non-citizen and it wont be considered as a crime as non citizen are not mentionned in the Constitution. If you kill a non citizen then according to your understanding, no crime has been commited...

I'm not afraid. I'd much rather released detainees stay in the US, where we can keep an eye on them and where they are LEAST LIKELY to cause harm. If we ship them back to wherever, we're just making them someone else's problem. They are still our problem, especially now that we've incarcerated them for X years. We just won't be taking responsibility for the incarceration. No follow-up. Shortsightedness. Willful ignorance of potential blowback., &c. Classic American blunder. Cf. US prison system.

Illegal Aliens do have a right to a hearing, in order to establish their status. They are not held indefinitely without charge or trial.
There is no such thing as an enemy combatant. There is something known as an illegal combatant under the Geneva Conventions, and they are too entitled to a trial.

Habeas Corpus does NOT have the word "citizen" in front of it, and in order to have due process you MUST have habeas corpus.

Theillegit - actually, even illegal aliens and resident aliens (green card holders who are not yet citizens) are given hearings to determine whether they should be deported (5th and 14th Amendments - no PERSON shall be deprived of life, liberty or property without DUE PROCESS), and they are innocent until proven guilty. Why the FUCK is this even an issue? Whats wrong with gitmo? WTF has happened to us? Sympathy for criminals that hate us? How stupid can we get, I hate that the rest of the world thinks of us as 'dumb' Americans, but I can see why.

They think we are dumb because of people like you. The people in Gitmo were never tried. For many of them, there is ZERO proof they did anything wrong.
So now that we have locked a bunch of people up with no proof, what do you think we should do? Do you really think it's right to leave them in prison if some of them didn't even do anything?
On the other hand, now that we have locked them up, that may have turned many of them into potential terrorists. I know I'd be pissed in their shoes.

Also, placing them in maximum security prisons isn't forcing these prisoners to be in our "communities" technically. They are behind bars if anything. They will get tried, and if prosecuted spend their time in jail. The culprits for the first WTC explosion in 1993 are still in a Colorado prison. The same goes for the Unabomber and Terry Nichols. Again, is there anything wrong for these "enemies of the state" to be quarantined to maximum security prisons with U.S. rapists and murders?

Under what authority are enemy combatant, non-US-citizens deserving of right to trial or habeas corpus? Certainly not under the Constitution (ie. the law of the land). And for habeas corpus, only under the authority of recent judicial activism citing foreign law as a basis for interpretting American law. Completely illegitimately and unconstitutionally.

Under what authority does the US have the right to confine foreigners indefinitely with no trials?? In fact, there are many laws that specifically say we CANNOT do that. What if some other country tried to arrest US citizens, in America, and put them in a foreign prison with no trial??

No where in the constitution does it say that the laws therein only apply to U.S. Citizens. It is the law of the land, to be distributed equally among all it's denizens. Citizenship only comes up in matters of voting and holding office.

someone has a brain... whenever I hear from people who try to support GITMO and torture and the US PATRIOT act it astounds me they call me close minded... we can't lock people up and not give then rights to defend themselves, nobody can tell me a conviction that has come form GITMO, which means a lot of them are being held for no reason. I wonder why some of them would be mad at the US?

Happens all the time. If they were being held unjustly, then I guess we might take action.. and if any country or government wants to claim these criminals as their own, they can come get them.

theillegit - I see you still haven't responded to the fact that habeas corpus does not only apply to US Citizens. And it isn't "judicial activism" - they were interpreting the Constitution and the laws - it is called judicial review, something that has been going on for over 200 years.

I'm not so sure there is a way around it. Certain countries won't take them back, and unless sufficient evidence to convict exists that is exactly what the law will force Obama to do. they let out dangerous kiddie diddlers into communities with kids, why wouldn't they let out would be terrorists if evidence is insufficient to convict ? I agree these GOP folks are scoring political points here, but the facts remain. It was the dems in congress who took out Obama's relocation money

I don't know why Obama hasn't elaborated on this issue more. There's no way he is stupid enough to release them in America under any circumstances. It would pretty much be political suicide. I don't know why he hasn't let us know the details of his plan though.

it is political suicide, but sometimes the law trumps politics. If they do close gitmo, he isn't going to have a choice in the matter. It's not like he consulted congress on how he was going to close gitmo, he just did it, but congress isn't stupid and they want to keep their cushy jobs so they refused his request for funds to relocate them. It's unfortunately a case of pure politics and the law.
