  • Clueless and self-absorbed video, uninformed "opinion" versus any concrete knowledge of law. You can indeed be detained without arrest, including search and restraint. even without a warrant, and even including use of deadly force. Yes, it's perfectly true! The ONLY right you have is to be brought before a magistrate without delay to force the detaining (or arresting) officers (or citizens) to justify their treatment of you. That is the law, and predates even the United States Constitution.

  • @guitarbridgecleaner From what I understand in this case Bundangbear was going to a Phish concert and this cop stopped him because many who do tend to smoke pot. I think the cop said he was pulled over because he saw thick smoke coiming out of the car window or he smelled it. I don't know if anything comes up under his license ID and tag check. I know many small towns who will pull over anyone who is driving past 12 a.m. hoping they are coming back from a bar. It's a big money scheme.

  • The difference is in being "detained" or "arrested". Probable cause needs to be established. A Cop using a "hunch" is not probable cause. If you are detained, the police do NOT have the right to take you from the scene OR place you in their squad car. At that point you are under arrest. (arrest... not allowed to proceed). I sure hope he wins this thing, the 4th amendment needs some good love and people need to see that the Constitution actually DOES indeed work for the people.

  • @mia0899cs Oh, the Cops CAN handcuff you when you are being detained, They just aren't allowed to take you from the scene or force you into their squad unless you are under arrest. If you do it willingly, that is another story. Never fight about it with a Cop. Nothing good can come of it.

  • @mia0899cs I agree, most of my dealings with the police have not been pleasant at all. I used to look up to them, now I fear them as probably most people do. That is sad.

  • @BikerBry It's sad as I fear many of them too. I grew up in a small town with cops that were crooked and nearby other small towns where they have a reputation for doing horrible things to people.

  • @mckerob I know there wasn't an arrest and that's why the video is titled"...WHILE NOT ARRESTED." How is it legal to detain someone who isn't arrested? He posed no threat whatsoever and cooperated with the officer. He had the right to refuse his car being searched. He won the case so the officer was wrong. These cops are just abusing their power.

  • I suggest people Google the name "Steve Rievley". He is a small town cop that ended up in federal court. The interesting thing is the person that sued him represented himself and actually prevailed. The judge blundered the jury instructions and now this Rievley policeman is expected to face perjury charges and the cops attorney will have to answer to his subornation of perjury. There is much that can be learned as this whole lawsuit has been posted and talked about all over the Internet.

  • @WolfEagle1961 There's a big difference between the two cases presented, however. The Steve Rievley case is clearly a violation of Constitutional rights. There was a forced entry into a home without a warrant. which is strictly prohibited. Bundangbear's case involved a search of a vehicle with probable cause, which has generally been allowed.

  • arrested means stopping your phycial movement without your consent. so he was arrested. this is "false" arrest.

  • @circusboy90210 Police are allowed to temporarily detain an individual when there's suspicion of a crime. This includes ordering the individual out of the car. While I agree the hand cuffing may have been a bit unnecessary, I'm assuming this would be allowed for the safety of the officer involved, especially when he's alone. You don't want the suspect going for a weapon or making a run for it right as the officer is about to discover the heroine stash hiding under the seat.

  • @kwikrnu I totally agree. There was no reason to detain Bundangbear because he wasn't arrested. It's unconstitutional and I'm glad that he videotaped this. Some of these cops think they can get away with anything.

    1) They do not need a search warrant when they get a positive hit with a K9.

    2) You were detained for your safety and the officer's (legal)

    3) You edited out the sections of the video where the officer told you that it's ok to film it

  • i watched the video of Bundangbear and what the cop did was horrible. i wonder if there is a way to show the video and have the cop lose their job. medicine is important and you can't deny someone it. the cop abused his power and does not deserve to be a police officer. i am glad Bundangbear filmed this because maybe he can use this as evidence.

  • Yes, I agree with you that some cops are assholes. I lived in a small town and these cops were only there to harass the community. We called them the Town Clowns. Whenever something serious happened they called in the SWAT team.

  • You are absolutely right Tom! We need to gain back our rights. I remember when CPS made me get an electrician before James could come back because of a blown hallway light. I had to sign over his Dr. records. I told them that I feel it is against his HIPPA rights. They said they thought I was hiding something. I was a Hospice RN and he went to Daycare at the YMCA. I shouldn't have handed them over unless they had a court order. CPS is another one who can't search your house without a permit

  • Over time I've lost respect for police after getting pulled over, detained (not arrested) for not having an ID when I was 18 y.o. (I was walking to work), cops looking in my car at least twice a year with flashlights while it was parked at the rec. center, etc. Being a policeman used to be an honorable job. Now they're just gun-toting, rights-infringing tax collectors.

  • That's horrible! I remember when my car was hit while it was parked on the street. My parents were called. They wanted to search my car, and not the person who hit me. Unbelievable! My mom said, "Absolutely not!" The woman totaled my car. I was in my early 20's and she was middle aged. I wasn't even there, but my parents didn't trust cops because they can plant drugs in your car. My dad was always one step ahead of them.

  • @cknight63 You'd be suprised how many idiots leave guns and drugs laying around in plain view in the vehicle. It's not a violation of anything, people who break into cars look into them before breaking the window. So if you have nothing in the car what are you getting so pissed off at them looking through the window not searching it for? They can also take the trash that you put at the curb and search that. I say go ahead and look through the window your wasting your time but oh well.

If u think they're violating rights now, I guess u've never heard about someone getting beat with a baton for disrespecting a cop back then. There's a lot better oversight now then there ever was. Look at how many were corrupt in NY, Chicago, Las Vegas, or backwoods US, "I can give u a $100 speeding ticket or you can pay me $50 and I dont give you one." When you have no boss right there, its easy to do what u want.

  • They did bully you and you are right many people would forgo their 4th Amendment Rights. If I get stopped, I hope that I can be as strong as you. It's a frightening position to be in. Shouldn't he have had his hat on btw? They have to in NJ or they lose the case and I think they get in a lot of trouble if not suspended. He reminded me of Mark Furhman. When I was in my 20's my car got hit on the st. and they called my parents and they asked to search my car. My mom said, "No!" Why mine?

  • I know they do it all the time. I don't even know what's amended anymore. When I was stopped by NJ State Police many years ago for not having my turn signal on when changing lanes, the cop checked my car too. I wasn't impaired or anything, but I guess they feel it's their right. Well, he checked my car and than I was permitted to go. Probably, pissed him off.
