I think the cop said he was pulled over because he saw thick smoke coiming out of the car window or he smelled it. I don't know if anything comes up under his license ID and tag check. I know many small towns who will pull over anyone who is driving past 12 a.m. hoping they are coming back from a bar. It's a big money scheme.
The difference is in being "detained" or "arrested". Probable cause needs to be established. A Cop using a "hunch" is not probable cause. If you are detained, the police do NOT have the right to take you from the scene OR place you in their squad car. At that point you are under arrest. (arrest... not allowed to proceed). I sure hope he wins this thing, the 4th amendment needs some good love and people need to see that the Constitution actually DOES indeed work for the people.

The judge blundered the jury instructions and now this Rievley policeman is expected to face perjury charges and the cops attorney will have to answer to his subornation of perjury. There is much that can be learned as this whole lawsuit has been posted and talked about all over the Internet.

@circusboy90210 Police are allowed to temporarily detain an individual when there's suspicion of a crime. This includes ordering the individual out of the car. While I agree the hand cuffing may have been a bit unnecessary, I'm assuming this would be allowed for the safety of the officer involved, especially when he's alone. You don't want the suspect going for a weapon or making a run for it right as the officer is about to discover the heroine stash hiding under the seat.

I wasn't even there, but my parents didn't trust cops because they can plant drugs in your car. My dad was always one step ahead of them.

1) They do not need a search warrant when they get a positive hit with a K9.
2) You were detained for your safety and the officer's (legal)
3) You edited out the sections of the video where the officer told you that it's ok to film it
