Second. It was a pretty good concise explanation of this landmark case, but I think you should have mentioned why Marshall ruled that the Sup. Ct. couldn't rule on the issue (jurisdictional issues with the states). This was all B.S. He came up with the sneakiest, most clever way to keep
@redresch judicial review, while at the same time, not mandating that Madison (Jefferson) show up at the Supreme Court as a named party. (which was never going to happen) He essentially threw out the case, while at the same time maintaining the power of judicial review. This infuriated Jefferson because there wasn't much he could do. The great Judicial Federalist John Marshall pulled a fast one on the Jeffersonians.... Brilliant!
