  • gotta tell ya, the camera guy is a punk ass that needs to be hammered in the ass in JAIL..!!!!! phtographs of persons and structures is illegal once the other person declines to allow that person to fotograph him / her., to continue constitutes harrasment / provocation and when convicted on it, can face a max sentence of 1 year in the county jail......ASSHOLE..!!!!!

  • legal or not aside, there is one thing that is more important than the law and that's RESPECT. being up in people's faces with your camera or ihpone etc is completely disrespectful, of course it's an easy way for losers to feel some form of empowerment but if it comes at the cost of people's privacy. this isn't a freedom you should exploit, shame on you. you think you're safe because you'll 'put it on Youtube otherwise' ...keep it up and one day someone's gonna lose it and go to town on you.

It's about what the law SHOULD BE i.e. why should it be that an individual cannot harmlessly film in a shopping centre open to the public? The owner of the shopping centre should not be allowed to prevent such innocent conduct in a free country. That's the point the film maker is trying to make here (whether or not he's annoying is totally irrelevant)

  • It is private property that is generally open to the public like a shopping mall. It would be an interesting case. I think that it is 50/50 that the courts would enforce the law.

  • Camaras are for public use anywhere, when you are on private property and it has been stated that it is not permitted or desired then you don't film. Same goes for if someone doesn't want to be on camara no matter where they are. STOP HARRASSING PEOPLE

  • Just because the building doesn't have high gates in front of it doesn't mean it's not private property. It aslo cleary stated where you could film, and that filming was prohibited in the vaccinity of the property. Private property dosent also need to have fences and steel gates around it to make it private. In your home, you have absolute expectation of privacy; however, just as an example, if you were in your home-with your windows completely open, he could theoretically stand on the sidewalk and film you. Don't scream at me-I'm not saying it would be right only legal. The public is mostly ignorant about 'rights'

If you, of your own free will, choose to go out into public, you lose any "reasonable expectation of privacy". If you don't want to be filmed, the legal onus is on you to either move to an area where you do have a reasonable expectation of privacy, or to obscure your face somehow.

    Well, there would still be negative reinforcement, even if there were no government. You could hire private police, or my preference, volunteer police, and historical Anarchies had private courts to prosecute criminals.

    Only a small proportion of society is inclined to violence, most people aren't criminals, and violent crime is psychologically motivated so the solution is better support for mothers and children, not violently enforced governments.

    As of February 16, 2009, in Great Britain / UK it became unlawful for a tourist or a photojournalist or a TV video crew to photograph or record a video that includes an image of any law enforcement officer under UK Section 76 Counter-Terrorism Act 2008.

Photographing a cop can land you a fine or even a 10-year prison sentence.

If you photograph or film police during their duties in a public space you can not be punished. Police are using the section 44 laws irresponsibly but are under instructions to use it sparingly, even if individuals dont.

    An act, statute or code is not law. An act is given a force of law with the consent of the governed (that is you and me). The act you quote may make filming illegal, but not unlawful. There is a great diffrenece between illegal and unlawful - study "FMOTL". As long as you are not breaking the law i.e. committing a crime, you are OK and can sue the fuck out of anyone that restricts your rights. As for what constitutes crime, google what are the elements of a crime.

    There at 2:43 you see it. But she's wrong about taking anybody's pic. If you go outside the line, you can still film inside the line as long as you can see it from the public sidewalk.

  • As a matter of fact, even if you are on private property, but in a public space, like a street, mall or train station, you are permitted by law to take photos if you do not interfere with certain things, like blocking the way of people. If you bought a ticket to enter that space, they can't accuse you of trespassing, but even if they do accuse, they NEVER have the right to confiscate your equipment or make you delete images.

    Best thing to do in these situations - Tell them to call the Police.

  • i would like to comment on what you have said - they never have the right to confiscate your equiptment or make you delete the images - i agree with you, they do not have the right to confiscate your equiptment, but do have the right to ask you to delete the image if they are init or even edit them out of it, as of filming they can ask you to stop filming them.

  • Actually, there is no offense in capturing an image in a public space. Publishing or selling it is another story :)

    I like to believe that this is still common sense.
