  • In a private ceremony or church marriage, the state or society do not have a right to tell you who you can or cannot marry. however, as soon as you step outside the private realm of RELIGIOUS marriage and enter into the public sphere of CIVIL marriage, you are subject to the law and public opinion or vote because civil marriage is about public policy.

    so, YES, you have a fundamental right marry that doesn't mean you have a right to marry sister

  • When the gov wishes to deny equal protection of rights, it must offer proof of some rational basis and/or compelling state interest in withdrawing equal protection. The gov can offer a rational basis for denying legal recognition of incestuous relationships.

    The counsel for the defense of Prop 8--ie YOUR side--when asked in federal court last month what proof of a rational basis it had for denying ssm, answered "I don't know." It was a historic--if under-reported--moment

  • That doesn't make any sense. People are trying to use their RELIGIOUS beliefs to deny people marriage.  There is no valid public-policy basis behind it.

  • the state has a interest in PROMOTING procreation into an environment where theres two biological married parents present the state does not just want to promote the ideal environment for children but they want to promote the common good through ensuring the well being of children

    by infusing same sex couples as apart of that meaning and word, you would not only promote motherless and fatherless environments but prioritize the needs and desires of adults over the needs of children

  • The government is for everyone, not just children, or couples with children. The government should not be promoting more children. There are more children than straight society certainly can handle.

    But even if it is just about children, it's in the interest of children for there to be more and better homes for them to be in when they can't be with their biological parents or when their biological parents can't handle the responsibility.

  • Single parents are allowed to raise children. Those are motherless and fatherless homes. But two parents are better than one.

    Government is not about social engineering anyway. It's about the protection of the rights of individuals from the rights of other individuals. Until a gay marriage actually hurts you, you don't have the right to use the government to stop it.

  • in issue dealing with public policy, we actually do have a constitutional right to use the government to stop it with the power of democracy

  • Read the 14th amendment. We do not have an absolute democracy. For example, we cannot vote to end the right to free speech or end the right to due process. We cannot vote to bring back slavery. We have a constitution that limits the government's power. The founders were very wary of the dangers of tyranny of the majority, and that's exactly what you propose.

  • if you Go to Wikipedia and type in Baker v. Nelson, The case will show you that the same court in Loving v Virginia not only distinguished same sex marriage from interracial marriage, but established it as a right that does not exist under the constitution and never did.

    so the 14th amendment does not confer a RIGHT to gay marriage anymore than it does for polygamy

  • therefore, Same sex couples do not have a SPECIAL right to redefine marriage for everybody else; the " will of the people" have a FUNDAMENTAL right under the tenth amendment to do such a task because we live in a democracy not an aristocracy. In baker v. nelson, the case called citizens for equal protection will show you in their conclusion that citizens do have a right to vote on rights just as long as they are NEW rights , such as same sex marriage.
