I think Porn vs Art has as much or more to do with the intention of the maker as the eye of the beholder. If you are creating a scene meant mostly to arouse the viewer sexually, its probably porn. If you are creating a scene that has deeper meaning and is mainly meant to be appreciated on a deeper level, then its Art.

I think art becomes pornography when it is cheap and follows the profit-motive. But, the term "Cheap" is very subjective. I hope most of you guys/girls know what I mean. I wouldn't say penetration is the difference. There are many beautiful pictures where two people are making love. It looks very sensible, aesthetic, and not erotic. Like a mother feeding her baby. Most people don't think it is erotic even though you see a lot.

I think it's a matter of common sense. It's all about the intent. Clearly Vivid Video isn't looking to create an artistic picture. The intent is to sell sexually stimulate for no other purpose than, well, you know.
Then again, the production crew could actually be practicing their art of editing/shooting etc. Maybe it's not that simple after all. I say we simply need to be a little more open but still keep some morals.

I've never understood art anyways...I don't see how a line on a painting for example can be worth 3million dollars.Art is a joke why is something only considered art when some snob claims it to be. Other then that theres no way to say one thing is art and no thing is not.

It's simple economics. It doesn't matter if some expert says something. If an artist can charge 3 million dollars for a piece and someone is willing to pay, then there is a market for that piece of art at that particular price. End of story.

It changes over time. Here in Canada "obscene" material is defined based on a survey of opinions of what Canadians think other Canadians find offensive... To allow for social changes over time.
But obscene material is illegal... porn is obviously not.
Porn is considered to be anything that is intended to be sexually arousing. If sexual arousal is not the intent of the product, it's not considered porn.
