We should not have this problem if the military executed them in the first place. Combatants are persons not supported by a country and do not wear uniforms. According to the Geneva Convention these terrorist can be executed.

Some of the top AQ leaders in Gitmo were water boarded which is illegal under USA law. If these guys up for trial under USA law they will walk.
I bet few of these guys were read their memoranda rights and come up with a host of other reasons why their rights have been violated.
