This almost happened to my dad. This guy was a serial rapist/murder. A girl who he raped got away, & told the police. My dad got arrested. When the trial started, the girl said that my dad wasn't her rapist bcuz the guy who did it had tattoos. It just so happened that the real rapist was caught by some other police for committing another crime & was in the court house at the time. The only thing that save my dad was that he didn't have any tattoos. My dad said the guy looked just like him.

if you're 14 and commit certain crimes you get waived as an adult. I spent 15 months in jail at 16 facing 20 years in prison for a mistaken identity as well. I could not make bail but beat the case in the end. Now what really sucks is when you get released they pat you on the back and say "oops" and you can't take any form of legal action against them.

These two don't look identical, but they are close enough to be a reasonable case of mistaken identity. They seem to have the same eyes and hair color. Creepy part is how it looks like they even have the same ear rings. However, I'm shocked to find out that it took seven days to get this cleared up.
They don't have her fingerprint because she had never been arrested. I'm thinking they have an eye-witness or caught the crime on camera to have made a mistake like this.
Yes, in fact my prints are on file. Not because of anything bad that I've done, but because of my job that I do. I'm very aware of the law and I'm stating that as a Canadian, we have the best records . We make sure to fingerprint anyone and everyone who has been charged and thus not so many kinds of errors occur. I feel bad for that poor girl and sorry for anyone who has to go through such an ordeal.

I saw this case posted at least 6 years ago, I am sure she is over it by now. However, it can't be any worse than the recent woman who spent 2 months in jail because of mistaken identity. After her case was dismissed, she spent an extra 'week' in jail. Whats worse? The mistaken identity was not from appearance, it was simply by the same first name, horrible.
Not just same skin colour, hair colour, and earrings, but also same makeup type, hair STYLE, roughly the same age. Many people give wrong accounts of what criminals look like after experiencing the crime. They should have looked for more/better evidence before incarcerating her. :(
I entirely agree--that woman's record should be expunged completely. Failing that, a good civil rights attorney ought to be able to not only get the record expunged, but enough money that she won't have to worry about looking for a job any time soon. If those responsible for this sort of thing have to pay (literally or figuratively) for their actions, we'll see a sudden stop to ridiculous stories like this.

Tell me how fingerprinting would have helped in this case. Did you actually read the description of why she was arrested. Eye witness picked her out of a line up, but did not know her name.

So, she would be in the system and I don't know how it is anywhere else in the world, but in Michigan one of the first things to happen when you get brought into a jail is you get fingerprinted A. to put you into the system, and B. to identify you as the correct person. That's how they would have helped. Any further questions?

I don't know how it is in Michigan, but in the rest of America we use the FBI database where fingerprints are associated with a name. If they ran this 17 Y.O. fingerprints they would have come back to her ID if she had priors, but that still would not have helped her, as police did not have a name to work with, just a photo.

I trust this young woman's record of having been arrested and charged with a felony will be removed from police department computers? If it is not, it will pop up the first time she has a traffic stop, and could lead to further problems.
She will also have been fingerprinted, a mug shot taken, and possibly required to provide a DNA sample. All of that should be destroyed. This woman committed no crime, and should not be "on paper" as someone who was arrested and charged for having done so.

These two don't look identical, but they are close enough to be a reasonable case of mistaken identity. They seem to have the same eyes and hair color. Creepy part is how it looks like they even have the same ear rings. However, I'm shocked to find out that it took seven days to get this cleared up.

Yes, in fact my prints are on file. Not because of anything bad that I've done, but because of my job that I do. I'm very aware of the law and I'm stating that as a Canadian, we have the best records . We make sure to fingerprint anyone and everyone who has been charged and thus not so many kinds of errors occur. I feel bad for that poor girl and sorry for anyone who has to go through such an ordeal.

I agree, however that 1 million is from our pockets, not theirs. That's the unfortunate part, other than this poor girls affair. I saw this case posted at least 6 years ago, I am sure she is over it by now. However, it can't be any worse than the recent woman who spent 2 months in jail because of mistaken identity. After her case was dismissed, she spent an extra 'week' in jail. Whats worse? The mistaken identity was not from appearance, it was simply by the same first name, horrible.

Not just same skin colour, hair colour, and earrings, but also same makeup type, hair STYLE, roughly the same age. Many people give wrong accounts of what criminals look like after experiencing the crime. They should have looked for more/better evidence before incarcerating her. :(

I entirely agree--that woman's record should be expunged completely. Failing that, a good civil rights attorney ought to be able to not only get the record expunged, but enough money that she won't have to worry about looking for a job any time soon. If those responsible for this sort of thing have to pay (literally or figuratively) for their actions, we'll see a sudden stop to ridiculous stories like this.

@MrThaiBxr Well you see, usually people who are out committing crimes have prior convictions, even misdemeanors get fingerprinted. So, she would be in the system and I don't know how it is anywhere else in the world, but in Michigan one of the first things to happen when you get brought into a jail is you get fingerprinted A. to put you into the system, and B. to identify you as the correct person. That's how they would have helped. Any further questions?

@kolektiv7 Well if you actually read the scrollling report, you would see that the man who identified her from a photographic line up did not know her name. I don't know how it is in Michigan, but in the rest of America we use the FBI database where fingerprints are associated with a name. If they ran this 17 Y.O. fingerprints they would have come back to her ID if she had priors, but that still would not have helped her, as police did not have a name to work with, just a photo.

It is very concerning in general - in particular those cases of people charged with murder who have later been cleared after DNA testing was finally introduced but lost so many years of their lives. I understand it's important to catch criminals, but things like this are scary. I really hope the paper trail from this doesn't bug her forever..

I trust this young woman's record of having been arrested and charged with a felony will be removed from police department computers? If it is not, it will pop up the first time she has a traffic stop, and could lead to further problems.
She will also have been fingerprinted, a mug shot taken, and possibly required to provide a DNA sample. All of that should be destroyed. This woman committed no crime, and should not be "on paper" as someone who was arrested and charged for having done so.
