@A0den I take it you dont know the laws and legalities of photography & video, I do as I am a photographer by profession! I know that I CAN legally copyright something that I have done & actually as soon as I take the pic or video it is actually already protected by the copyright laws! I put it there physically for my own protection. Before you start talking smack about something why don't you look up the facts first so that you dont sound like an imbecil!!! have a GREAT day!

@shar869 Actually, for whatever it is worth...you can't. Daughtry owns the copyright to his own performances, so unless you received permission, you've violated his performance copyright rights by making a videotape copy of it. And no, it doesn't matter that he was in Canada at the time.

@aron2631 Yes that they do BUT when they give permission for video and photographs to be taken durring the performance, they then loose the "sole" right to them. They then can be recorded & captured by his audience & copyrited by them! Being in Canada had nothing to do with it. I was simply stating to the person that I was physically there. This is what I do for a living so I DO know the laws of what can and can not be done. If you look @ my status on YouTube I am a "copyrited" account.

Daughtry is talented hands down. It's unfortunate that he lost in American Idol. But I personally cannot listen to his cover of Poker Face without cringing. He did an acoustic cover of a Lady Gaga song. Daughtry isn't the only one who did a Lady Gaga cover though. Let's not forget Greyson Chance and his piano cover of Paparazzi

Can you perform other peoples songs in concert without paying royalties? I mean technically since these people paid to see him, the song is making him profit...right?

A performer can perform ANY song that they want at a live show, they dont make royalties on the live performances, If it is to be televised or recorded then the artist needs to submit for permission to do so from whom ever ownes the rights to that perticular song. Oh yeah!.It is your concert that you are giving and how you want to perform it!.You can play as many cover tunes on stage as you wish with out legal matter! Perfect example..the song "Knockin' on Heaven's Door" by Bob Dylan was covered by countless of bands that was played live. The band I play in, we would plan our list of songs half cover and half original during our shows which works out perfectly. The sky's the limit! Go for it!..Just don't RECORD songs that is not yours with out permission.

venues must pay a monthly fee, to prs or something like that, which covers them financially for people performing covers. because technically you are meant to pay to play other peoples songs. but if the venue isnt paying those fees, then you as an artist are in no danger as you must assume they have paid them.
