It's not really that implausable, we live in an age where you can buy a Hind-D over the internet.
The disclaimer starts at 0:25 when it says that the offer is not available in all areas and to please see the Pepsi Points catalog for further details. The jet is not listed in the catalog, and the order form in the catalog states that only the items in the catalog may be redeemed with Pepsi Points.
That doesn't fit the legal definition of fraud. Pepsi didn't create the ad as an intentional hoax for personal gain. You could argue that they did gain via the man saving up 7,000,000 Pepsi points, but he didn't actually earn the points. He sent Pepsi a check to "purchase" the points, and had the check returned with an apology.
I just read about this case in my contracts book and was wondering about it. Now that I saw it I can understand why the guy really tried for it. I think the first hint is was not possible was the catalog not having it and also no place on the form. My only question is who was the lawyer who actually thought this guy had a case.

I've just read the John D.R. LEONARD v. PEPSICO, INC. case report. I don't know what to make of it other than it's fucking hilarious. In theory, Pepsi should have gave him that jet.
i see no reason why you shouldn't be allowed to have one. any sort or ordinance you would want to add to it would have to have it's BATFE stamp of course. As long as you have the money and the proper paperwork, any citizen can have one.
If anyone had common sense they would know that winning a harrier isn't possible. However that's always been the problem with a lot of people they have no common sense and then whine about not getting the harrier that they should have known wasn't realistic to get. An average citizen cannot buy a fighter jet nor can a corporation.

Pepsi is just being a bunch of rude assholes with that new commercial. They changed the number of points as if to challenge someone else to get that many points, even though they already know that no one can sue due to a precedent set by the previous case. It's as if they're saying: "See, now you won't be able to earn the required points, and even if you can, we don't have to give you your jet anyway!"
The commercial never "promised" anything; it's not a binding contract. If they had said "your own domination of planet Earth: 7000000000000000000 points" would they have had to give that to whoever got the points also?
Although I agree that this ad is not an offer for a Harrier jet, I felt sorry for Leonard because he worked so hard to get the jet and never got it. :(
He really did not work that hard. He only collected 15 points. He wrote a check for the remaining points (which the rules said you could do). I say Pepsi-Co is a scammer and the law only protects criminals. @bjornjoseph Pepsi-Co refunded his money and said they cannot accept the check and said that commercial was only humor. @doktorZaius86 I think he was planning to sell it for profit..not to fly it himself. Guess he didn't realize two things: No reasonable person would expect to get a Harrier Fighter jet for $700,000, and even more key, an advertisement does not constitute an offer, only an invitation to deal. Sucks for that kid, since it must have taken some insane effort and convincing to get people to give him that much cash to actually try and get a jet

Finally, on August 5, 1999, a federal judge for the Southern District of New York held that PepsiCo was only joking when it implied in its ad that it was giving away fighter jets. Judge Wood noted that since the jets sell for approximately $23 million each, "no objective person could reasonably have concluded that the commercial actually offered consumers a Harrier jet." Instead, this was a classic example of "a deal too good to be true."

I got the glasses in this ad (didn't fit though), and a shirt that they didn't show in this one. Oddly enough, I still have the shirt, wear it about once a week, and it has yet to show any wear. I don't know what kind of magic material they made it out of, but I wish I could get more stuff made out of it.

Regardless of whether or not it was a joke, I do think Pepsi was guilty of fraud. I didn't see any disclaimer about the jet not being an actual prize in that commercial.
It's not really that implausable, we live in an age where you can buy a Hind-D over the internet.

The disclaimer starts at 0:25 when it says that the offer is not available in all areas and to please see the Pepsi Points catalog for further details. The jet is not listed in the catalog, and the order form in the catalog states that only the items in the catalog may be redeemed with Pepsi Points.

That doesn't fit the legal definition of fraud. Pepsi didn't create the ad as an intentional hoax for personal gain. You could argue that they did gain via the man saving up 7,000,000 Pepsi points, but he didn't actually earn the points. He sent Pepsi a check to "purchase" the points, and had the check returned with an apology.

I just read about this case in my contracts book and was wondering about it. Now that I saw it I can understand why the guy really tried for it. I think the first hint is was not possible was the catalog not having it and also no place on the form. My only question is who was the lawyer who actually thought this guy had a case.
I love studying about lawyers who made mistakes that resulted in the interesting cases!! Without them contracts and torts are not very interesting.

Pepsi returned his $700,008.50cents check along with some free product coupons and a letter saying that the Jet was not part of the offer in the Catalog. It went to court for summary judgment, judge ruled in Pepsi's favor. Further, private citizens cannot own military jets, nor can private companies like pepsi sell them. It was a null & void offer from the start. Pepsi was shocked anyone did not get that the Jet was just a funny gimmick, zany humor. 190 pepsis per day for 100 years lol

Pepsi is just being a bunch of rude assholes with that new commercial. They changed the number of points as if to challenge someone else to get that many points, even though they already know that no one can sue due to a precedent set by the previous case. It's as if they're saying: "See, now you won't be able to earn the required points, and even if you can, we don't have to give you your jet anyway!"

He really did not work that hard. He only collected 15 points. He wrote a check for the remaining points (which the rules said you could do). I agree they cheated him but I disagree he worked hard for it. Some dummy at Pepsi did not do the math. 7 million points was about $700,000. The jet cost 23 million. What a bunch of dummys. haha the ONLY people watching this video are law students. We studied this case, and i tend to agree that it is not an offer, seeing as there are no terms stated and a "reasonable person" could clearly understand that in the context of the ad, the jet was introduced in jest.
