  • TUS Supreme Court-12:These donations "demonstrate Rajaratnam's contributions were given with the intent of supporting specific LTTE attacks and operations," the complaint charges. The complaint also documents donations from the Rajaratnam Family Foundation to the TRO totaling well over $5 million from 2001 to 2007.

  • US Supreme Court-6: In a complaint filed in the U.S. District Court for the District of New Jersey in Newark, NJ, family members of those killed and survivors of bombings committed by the group formally known as the Liberation Tigers of Tamil Elam (LTTE), alleged that Rajaratnam and the family foundation headed by his father provided millions of dollars in funds used for the deadly and destructive terrorist attacks.

  • US Supreme Court-5: More than 30 victims and survivors of the terrorist group's attacks alleged, according to a report obtained by the National Association of Chiefs of Police.

  • US Supreme Court-4:The legal dispute arose from advice given by the Humanitarian Law Project to the Kurdistan Workers' Party and the Liberation Tigers of Tamil Eelam in Sri Lanka. Both groups are listed by the State Department as terrorist organizations.

Recently, Indicted Wall Street hedge fund manager Rajakumara Rajaratnam and his father, J. M. Rajaratnam, knowingly provided financial and other support to the Tamil Tigers

  • US Supreme Court-3: The USA Patriot Act makes it a crime to provide any form of support, including humanitarian assistance, to groups on the State Department's list of foreign terrorist organizations.

  • US Supreme Court-2: As the law now stands, suspects providing such services to Hamas, for example, may be sentenced to upwards of 10 years in federal prison.

  • U.S. Supreme Court -1: U.S. Supreme Court to hear controversial terrorism case.

The nation's highest court will hear a case that may redefine the difference between humanitarian aid and aiding and abetting terrorist groups such as Hamas, Hezbollah, al-Qaeda and Tamil Tigers.

  • As you Sow,so shall you reap.

  • Dr. DJ-10:Are we headed for a third great cycle of violence? Sri Lanka has experienced two so far: the violence of the Sinhala underprivileged youth vs. the System, and the youth of the Tamil periphery vs. the Sinhala heartland. Are we living through the prelude of a third cycle, this time of a Cold war turning hot factional strife turning into civil conflict- within the Sinhala establishment itself?

  • your idiot

  • Dr. DJ-9:In deciding that the terrorist suspects will be tried in civil courts in the USA, including New York, and in imposing an unconditional ban on torture, President Obama, ex-editor of the Harvard & former prof. constitutional law, made the point that a democratic state must be seen as morally superior to its terrorist enemies, and that conceding the legal rights of its enemies enhances this ethical superiority which in turn strengthens rather than weakens the USA

  • Dr. DJ-9:There should be no attempt to do both, i.e. to try him in a military and then a civil court, because the opaque character of a military court undermines the social legitimacy of the findings and could have an adverse effect on the public perception of the criminal proceedings themselves. If the case of an attempted coup détat is weak, there will be temptation to massage the evidence if the process is than transparent. This will not be possible in a civil court.

  • Dr. DJ-8:If Gen Fonseka and his associates have sought to usurp power, then the example of 1962 is the one the administration should follow, in order to avoid any hint of a witch-hunt and the persecution of a war hero. If there are serious allegations of a criminal nature, then all the more reason that he should be tried in a civil court and prosecuted to the fullest extent of the law.

  • Dr. DJ-7:Surely a lesson could have been drawn from the conduct of Madam Sirima and Felix, D. B. in the face of the 1962 coup attempt Those leaders smashed the coup attempt, but did not seek to try those involved under military regulations despite the fact that those regulations existed and the accused were serving officers of high rank. The matter was brought to court (despite some controversy regarding the role and rulings of the Privy Council), heard in court, & those found guilty were jailed

  • Dr. DJ-6:No enemy of Sri Lanka could have matched the damage done to the image of the country and the Presidency by our own Governments recent actions, commencing with the deployment of troops some with black masks—outside the Cinnamon Lakeside on January 27th. That clumsy melodrama (I was right there, being interviewed by Al Jazeera) permitted a different story line to emerge in and through the international media, obscuring the clear, conclusive electoral victory handed to MR by the masses.

  • Dr. DJ-5: Every state has a right to defend itself against attempts at violent putsch. A democratic state has an even greater moral right and obligation to do so. While there was every reason to launch a serious and thorough investigation into the activities of Gen Fonseka, an investigation that was multipronged and sweeping as it was deep-going, the manner in which he has been arrested and detained (nabbed brutishly as The Economist put it) as well the timing of that action has been appalling

  • Dr. DJ-4:4.Even the right or necessary thing, done in the wrong way or at the wrong time, can do more harm than good. Mao Ze Dong urged the importance of the correct handling of contradictions and this one, the contradiction between the state and Gen Fonseka, has been grotesquely mismanaged politically.

  • Dr. DJ-3: The Fonseka Affair, the timing and tactics of the handling of Gen Sarath Fonseka, and in general (pun intended) the handling of the post Presidential re-election period so far, has been no less a rarity, a perfect blunder.

  • Dr. DJ-2:The present path on which the government is proceeding is adventurist. It inhabits an echo chamber in which only the reverberations of its own ideological discourse are heard. This attitude needlessly exacerbates and prolongs instability, renders the political crisis chronic and endemic, and debilitates the nation. Unless the limits of power are recognized, this path will lead inexorably over the precipice.

  • Dr. Dayan Jayathileka - 1:

    1. I am proud to have supported President Rajapakse at the 2005 and 2010 elections and I think he is the best leader the country can have at this point of time. However, the practice of political cannibalism must cease! A balance must be restored.

  • Feb 15 (MoD) Germany is ready to help Sri Lanka overcome the consequences of 30 years of armed conflict and German development aid is very much focused towards this endeavour, Germany's Ambassador to Sri Lanka Jens Plotener said. In an exclusive interview with the Daily News, the Ambassador observed that the war has been won but building peace is a long and very demanding task.

  • Forget SFs utterances and forgive him, Prelates tell MR. Feb 15 (Island) The four Mahanayaka Thero including the prelates of Malwatte and Asgiriya in a joint memorandum have urged President Mahinda Rajapaksa to release General (Retd.) Sarath Fonseka and his colleagues in custody. The Mahanayake Theros have told the President that hatred cannot be conquered and therefore disregard what Fonseka had uttered during election times.

  • Feb 15 (wsws) In a further violation of basic democratic rights, Sri Lankan authorities are preparing new measures to censor Internet sites critical of the government. Reports of the plan emerged on several web sites last night, amid a widening crackdown on the political opposition, including the arrest last Monday of opposition presidential candidate, General Sarath Fonseka. more..

  • Crime & Punishment does not harm Democracy. heavy crimes should carry heavy Punishments Sarath Fonseka should get death panalty for betraying Sri Lanka (Democracy does not meen we have to let our country run by bunch of loonies & LTTE Terrorists)

  • Rajapakse a true sinhalese? Is that why he is letting Karuna and KP live like kings? Do you know that KP is in an undisclosed 5 star hotel while a hero like SF is in jail? SHAME ON YOU!

  • "Under no circumstances can we endorse the arrest of a war hero who delivered the country from the clutches of terrorists," the monks said in a letter to MR, a copy of which was seen by AFP.

As the battlefield architect of the victory over the Tamil Tiger rebels last May, Fonseka was feted for finally crushing their 37-year campaign for an independent Tamil homeland.

The state-run radio station reacted by warning the monks against dabbling in politics and becoming an opposition mouthpiece.

  • Sri Lanka monks back arrested ex-army chief COLOMBO (AFP) Leaders of Sri Lanka's influential Buddhist clergy backed opposition demands Sunday for the immediate release of former army chief and defeated presidential candidate Sarath Fonseka.

Top monks of all key sects as well as the guardians of the island's holiest shrine, the Temple of The Tooth, made a joint appeal to President Mahinda Rajapakse to free Fonseka, who was taken into military custody last week.

  • DBSJ-14:At this point of time the state is yet to garner sufficient evidence warranting speedy action against Sarath Fonseka and his alleged chorts in a coup conspiracy. But informed sources revealed that much progress has been made in pursuing a line of inquiry into an alleged coup detat conspiracy. These sources seemed confident that a valid indictment and trial would materialise very soon.

  • DBSJ-13:Against that backdrop the situation seems to be that of the Govt procuring enough evidence through interrogation and investigation to construct an effective case against Sarath Fonseka over a coup detat conspiracy. It also appears that the Govt will resort to both a court-martial by a military tribunal as well as an indictment under the penal code in a civil court.

  • DBSJ-12:These denials notwithstanding the Government is firmly of the opinion that a coup with wide ranging implications had been planned and that the JVP too was linked to the conspiracy. Despite charges of political vendetta being levelled against it, the Govt has thought it fit to go ahead and arrest the chief Presidential challenger.

  • DBSJ-11:Later when the Lakeside Cinnamon Hotel was besieged amidst charges of a coup detat being planned there, the General again dismissed them saying that nobody would try and stage a coup from that Hotel. Besides, Fonseka said that his wife and daughters were with him there. After his arrest Mrs. Anoma Fonseka has also emphatically denied that a coup was ever planned at that Hotel.

  • DBSJ-10: The real conspiracy they say is not the alleged coup conspiracy but that of the ruling regime planning to penalise Sarath Fonseka through false accusations. Before his arrest, Sarath Fonseka had vehemently denied that he was plotting a coup. Had he wanted to capture power while in office as Army chief it would have been a simple matter to send a few battalions down to Colombo and take over the Government.

  • DBSJ-9:It remains to be seen as to whether these investigations would uncover genuine evidence about a coup being planned or not. However the powers that be seem convinced that there really was a plot and are determined to identify and charge the culprits.

On the other hand there is much doubt about this coup conspiracy theory. Many see it as a total fabrication aimed at stifling the chief Presidential contender and his political allies.

  • For all these issues mis used by the prevailing Presidents is caused By JR Jayawardena. What he forecast, His nephew have no capability to be in power.

Poor Ranil.... U must curse your Uncle JR.

Inform the nation, that your uncles mistakes, the nation suffers a lot in dictatorship. Tell the truth to the nation....

    Definetly you will be in.....

  • well, the rajapakse's have screwed it up BIG TIME now. all the foreign LTTTE supporters are laughing at us! how does one have the lunacy to incacerate someone like Fonseka? this isn't ranil, fonseka is someone who helped wipe out terrorism from the country.

  • I think govt trapped in a CIA conspiracy. When war was over, Sinhalese as well as Tamils and Muslims were relieved. Only party that was not happy was Pro-Eelam front. To make an opeing for war crimes investigation and unrest in Sri Lanka is to break the unity. SF did perhaps purposely the statement of testifying warcrimes knowing he get arrested so it will more easy for him to reveal war secrets. Govt also reacted accordingly. If SF is tried out in military court SF will compelled to reveal all.

  • DBSJ--8:Apart from detaining Fonseka the Government is also conducting a multi-level investigation into what it sees as a coup detat in the making. This includes not only probes into the conduct of serving and ex military personnel but also that of the pseudo-marxist Janatha Vimukthi Peramuna(JVP).

  • DBSJ-7:This paranoia or reasonable caution, depending on how one perceives it, explains much of the governments rationale in dealing with the Fonseka phenomenon before and after the Presidential elections.

It appears that the Govt is in possession of some information about the possibility of a coup engineered by SF. Of course the ex-army chief has strongly denied such an allegation but nevertheless the regime has gone ahead and arrested Fonseka in a crude display of power

  • DBSJ-6:Coup detat

The defence secretarys bold assertion that his former comrade at arms was planning a coup detat is perhaps the crucial factor governing the conduct of this Government towards the former Army commander and ex-Chief of Defence staff.

Rightly or wrongly the Rajapakse regime has been entertaining suspicion and fear for a long time that Sarath Fonseka was plotting a coup against it.

  • DBSJ-5:Whatever the merits or otherwise of the Defence secretarys response, it certainly seemed to have impressed the newspaper concerned as the highlight of the interview. So much so that the heading given to the feature was He was definitely planning a Coup.

  • DBSJ-4:He was planning on a military rule. It was very clear in the latter stages, in the way he had spoken and addressed the people. He said he wouldnt allow the politicians to rob the military of the victory they had achieved and offer a political solution. He was completely trying to isolate the politics and take the country on a different path. In his very last stages as army commander he began bringing his people into Colombo and his regiment, positioning his senior regiment ppl all over.

  • DBSJ-3:Given the furore surrounding the arrest one may have expected the Defence secretary to be a little evasive or diplomatic in commenting about the retired four-star general but Gotabhaya-true to form-was bluntly open and pulled no punches in answering.

When Velloor raised the issue of Govt fears that Fonseka was conspiring to lead a coup attempt Gotabhaya did not mince his words in replying. This is what he said-

  • DBSJ-2: This characteristic was very much evident in the telephonic interview given by the Presidential sibling on Wednesday Feb 10th evening to Ravi Velloor of the Singapore-based Straits Times barely 48 hours after the controversial arrest and detention of ex-Army commander and defeated Presidential elections candidate General Sarath Fonseka.

  • DBSJ-1: Were the General and JVP involved in a coup conspiracy?

A striking facet of Gotabhaya Rajapakses intriguing personality is the candour he displays in some media interviews. Instead of bluffing, sidestepping or trying to wriggle out of answering tricky questions the Defence secretary responds directly and fields them in a frank, forthright manner.

  • Mr. Amarasinghe said, The main reason for abducting Gen. Sarath Fonseka is to prevent the election petition he is to file against the results of the presidential election. The government is keen to prevent the petition being filed as there is evidence that the government had violated election law.

  • Feb 13 (NYT) On Friday, Sri Lankas supreme court ruled that Sarath Fonseka, the retired general who was arrested Monday night after his defeat in the countrys presidential election, will be allowed to challenge his detention in court. After the ruling the Web site Lanka Truth posted this video of one of General Fonsekas representatives telling reporters that the court had scheduled a hearing for Feb. 23:

  • HLDM-8: Fonsekas involvement with the assassination of Lasantha was confirmed emphatically by the Defence Secretary, Gotabaya Rajapakse, to the correspondent of The Strait Times. It is a statement that strikes a like bolt from the blue on the journalistic establishment. Yes, of course. We know there was no other person. You have to see the circumstances. Some of the media people harmed had never criticised any other person except him, or people close to him."

  • HLDM-7: This is a damning indictment of the conduct of Gen. Fonseka. Balachandran confirms that he had a gang of army men (translation: a private army within the Army) to attack journalists and others who he felt threatened by. Getting down to specifics he says: The assaults, murders and abductions carried out by this shadowy group, allegedly included the murder of the editor of The Sunday Leader Lasantha Wickramatunge

  • HLDM-6: He (SF) was also very sensitive to criticism and was the first Army Commander to have organised a gang of army men to attack journalists and others who he felt threatened by. The assaults, murders and abductions carried out by this shadowy group, allegedly included the murder of the editor of The Sunday Leader Lasantha. A serving Brigadier Duminda Keppetiwalana is currently under arrest in this case. The army chiefs actions brought a bad name to the MR government internationally.

  • HLDM-5: It is obvious that the collected first-hand information will be used like a hammer to nail Fonseka for good. Side by side with this evidence stands the menacing second aspect of Gen. Fonsekas tenure in the Army: he has been running a private army within the Army to deal not with Prabhakaran in the north but with his critics and opponents in the south. This is revealed by P. K. Balachandran of the Indian Express, a seasoned Sri Lanka-watcher wrote:

  • HLDM-4: He (Fonseka) used to telephone officers directly. Some officers told me they switched off their cell phones because of this. His campaign staff comprised mostly military officers and their main task was trying to reach the security commanders.

  • HLDM-3:The governments case against him is built on first-hand evidence of officers involved in Fonsekas plot. Defence Secretary, Gotabaya Rajapakse, told The Strait Times (11/2/2009) that officers are talking to him about the activities of Fonseka. He said: Our forces never used to be involved in politics but this time they were fully involved and this divided the military.

  • HLDM-2 First, there is the internal evidence collected from the rank and file. In it there is substantial evidence to establish a prima facie case if all his covert and overt moves to stage a coup under his command are put together. The finer details are yet to be revealed military sources have connected the links that point directly Gen Fonseka as the master-mind behind the military network getting ready to grab power in the event of a controversial margin of victory to a slim majority.

  • H.L.D.Mahindapala- 1 The mounting evidence from foreign and local sources against Gen.(retd) Sarath Fonseka, now held by the Military Police at a Naval base in Colombo, indicate that he is in deeper trouble than he knows.

  • A government spokesman also suggested that his crime was in fact to have got involved in politics while serving. Neutrals, a rare breed in Sri Lanka, a place long divided by war and now politics, may reserve judgment.

  • Feb 11 (Island) A fundamental rights violation application was filed by Mrs. Anoma Fonseka in the Supreme Court, yesterday, challenging the legality of the arrest of General Sarath Fonseka by the Military Police in Colombo on February 8. The petitioner requested the Supreme Court to grant interim relief by ordering the release of Fonseka on any condition the Court deemed fit or to order that he be produced before the Court at every hearing to ensure that he is in safe custody.

  • The UNP which is quite confident of its vote bank at the parliament elections can afford to do fairly well even without harping on the Fonseka factor at the forthcoming polls. It is only when it wants to give a classic example of gross erosion of democracy in the country that it needs to remind the electorate of his arrest. If Mrs. Anoma Fonseka decides to enter politics as a joint opposition candidate to avenge the punishment meted out to her war hero husband

  • Feb 11 (DM) Detained retired General Sarath Fonseka has been without medication for 24 hours while in the custody of the Military Police, according to his lawyer. Due to the injuries he sustained in a suicide attack there has been damage to his liver. Therefore he needs to have medication every six hours. However until the time we visited him on Tuesday night he had been without his medicine,

  • Feb 12 (UCAN) Buddhists and Christians have expressed concern about the arrest of the defeated Sri Lankan presidential candidate and the ensuing protests that have erupted in the capital. Protesters near the Supreme Court Complex clamoring for justice for former army commander General Sarath Fonseka were attacked with stones by rival groups believed to be government supporters, forcing the police to resort to tear gas and water cannons to disperse the crowds.

  • A regional human rights group sharply criticised Sri Lanka Thursday over plans to court martial the island's former army chief on charges of conspiring against the government. "The case is being pursued in military courts, thus avoiding the country?s ordinary courts and depriving him of due process," the Hong Kong-based Asian Human Rights Commission said in a statement. "This is also depriving the public of information on his case,"

  • this doesnt luk good for the country, first he accused the government of cheating in the election then he is arrested by the army,,, what does it say about the democracy of sri lanka ??

  • this is a power struggle. General is also partly responsible for the arrest. He made comments without thinking the consequences. Government took the chance to lock him up keep safeguard themselves from war crime allegations. SF's claim of rigging votes is unlikely. since they are manually counted and then computer fed. can be recounted if necessary. It is not General SF but his allies in question, some of them in favour of LTTE demanding for a separate state. SF and MR both are nationalists.

  • It say's Sri Lankan Law has gone to the dogs

  • Comment removed

  • General is not a nerd to testify against our heroic soldiers. He shouldnt and there isnt any war crimes to testify during war against LTTE. Solve your personal issues at personal level, not on a national poduim!

    Release General Now!

  • If General Fonseka is tried under military law, then Mahinda Rajapaks and Goatabaya should also be tried in an international court o atleast Sri Lankan court. Dont let blow out of proportion.

Is Sr Lanka a Democracy, a Monarchy or a Military Regime? I thought MR was Abrahim Lincon type guy, but apparently heading towards Polpot type!

    Release General Now!

  • We urge government to release General Fonseka immediately. Do no take advantage from alleged political involvement during presidential campaign and apply military rules on him. Sri Lanka is a democratic country and we respect different political views. Do not preach military laws in Sri Lanka. People must rise up against arrest of General. He saved our lives, we will fight for his life. He played a crucial role in defeating LTTE. Do not harrass him. Stop nepotism. Release General Now!

  • Prof. G.L. Peiris today said that retired General Sarath Fonseka was being tried for charges under the military laws enacted in 1949 and that there was nothing unusual about this. if the military did not have laws it was difficult to maintain discipline in a military establishment, Prof. Peiris said.

  • "SF had a wider frontage in dealing with the enemy , to attack from several places at the same time, Rajapaksa said. The army commander also used special forces and commando units in attacking the LTTE" Secretary of Defense said.

    Lankaweb/news/items09/150109-8

  • "Pointing out another reason why Sri Lanka won in the fourth Eelam War Gotabhaya Rajapaksa said Army Commander used tactics and strategy against the LTTE which Prabhakaran could not figure out how to react. He said the army commander used soldiers in small groups in attacking the enemy.

  • Gota: SF planned a Military Coup

He was planning on a military rule. He said he wouldn't allow the politicians to rob the military of the victory they had achieved and offer a political solution. He was completely trying to isolate the politics and take the country on a different path. In his very last stages as army commander he began bringing his people into Colombo and his regiment, positioning his senior regiment people all over. All these things were looking like a military coup.

  • India told gota that SF was planing to capture the Gov of sri lanka. and Gota told it to mahinda. why those idiots listen to Fucking Indians?

    ???

  • @kaludembara

Please do not be immature . When did the SL government listen to India ?

This is the sole work of the power hungry and Vengeful politicians of Sri Lanka. They do not need Indian advise for any thing.

Sri lanka ia faithfully following the footsteps of Iran. We all know how President Ahmadijedinad came to power in Iran !

  • rakapakse is a hero for stealing peoples money , epecially basil ponnaya, rajapakse can not win the war with out fonseka, and this is vengence. If Mhinda won the election, why he is taking revange from opposition??. Gen. manawaduge hates fonseka because fonseka is a straight gent. agaisnt curruption even he was in sri lanka army. he guided to win the war. All excellen SLA officers and soliders are with fonseka. If any SLA person who dosent like him, He must be a pathetic. GOD(S) BLESS FONSEKA...

  • If what the Sri Lankan government is saying is true, well, either this man is a traitor and has to be hunted down. Hunting other people has become the hallmark of Sri lanka. Is Sri Lanka a land of paranoics?

Beyond that how much more time is there, before the gunfire starts from both sides?

  • well done mahinda you the man ....i like kothapaya he is the strongest and anger man in SL ..keep doing same one day God will panish all sinhala ppl for killing innocent 50000 tamils in mullativu ...thats is happening now Buddha i believe youuuuuuu

  • lakshman hulugalle is an idiot who dosent know anything about sri lanka army, and the truth is sri lankan forces and people are getting divided by ponna rajapakse and brothers company. Many excellent battle field officers have already been expelled. There is a higher chance of dividing the country now. WE NEED A REVOLUTION.
