    Even that little drawing would count as evidence that we should be able to see.

    It has been a very long time since I was in a traffic court but I will be sure to keep this in mind. Then again I would always try and be as respectful as possible even if the officer was not being respectful to me.

    SMILE and take whatever on the side of the road and deal with it later.

People, study and challenge the accusations by using your irrevocable constitutional right to travel - it's complex but you can effectively fight this horrible rip-off by the state (whose employees judges are, BTW - conflict of interest!!!!

Coming from a guy that has had TWO DUI's thrown out of court, as well several traffic tickets, I'd say I question authority pretty fucking well. Your right about your correlation, but being an asshole to a guy that has the power (whether you like it or not) to write you a ticket, let you go, or cut you some slack, is just plain stupid.

  • @ldchappell1 If it makes you feel any better I can't fucking stand NC state troopers. They're the most useless, over the top, waste of money cops out there. But when I got pulled for my DUI (that got thrown out) was I a prick to the trooper? Absolutely not. When I went to court, and pleaded my case, and the judge threw out my case, I let her know that this whole thing was crap, respectfully of course. She said she agreed, and I said the next time this happened I would counter sue the trooper.

  • @ldchappell1 For making false accusations. I reminded her this was the second time I've had a bogus DUI charge put on me. She said "I understand Mr. Sahadi, you're free to go and have a nice afternoon." I said thank you, and walked out. Guess what, I run a bar, and drive a lot late at night, and for some reason I haven't had a cop on my ass ONCE since my court date. That was over 3 years ago. Coincidence? Maybe, maybe not.

Some cops think ANY kind of questioning is disrespectful which is why this "smiley" face nonsense is total crap. It's the officer's attempt at extending his power into the courtroom. The judge should decide based on the facts at hand, not whether or not you were having a "smiley" day. I'm glad you were able to win your case.

  • @ldchappell1 Trust me, I'm glad too. But I always remember being in court and hearing the judge ask the cop about the demeanor of other people in court. "polite and cooperative" was usually what the cop would say. I just don't think a smiley face is "secret code" for the courts. Cops have to make notes for themselves when they do go to court, they can't remember everything for months. It's not like they're writing some crazy unheardoff code, its a simple smiley face, or frown.

When the trooper pulled me over for my DUI, asked me to perform some sobriety tests (which I fucking NAILED FLAWLESSLY) and then decided to arrest me, I wanted to rip his fucking throat out (still do). But did I ever raise my voice, or become volatile?? No. I let him do his thing, while being respectful, and then shredded his ass in court. That's how you do it.

  • IF judges are using this to aid in determining sentencing, it is a flagrant disregard for due process. But since you have the right to see the ticket in court, you have the right to view both sides of the ticket.(Its already admitted into evidence anyways.) And IF due process is not being observed by the court and/or the police officer, you should be able to have the case dismissed on those grounds. Remember, you arent getting the ticket because of your mood..,or theirs! ;)

If this sort of thing is occurring at the low level of traffic court, what does that mean for cases where the stakes are much higher, for instance, where a person's freedom or life is on the line? This is disgusting. There should be a serious investigation into this perversion of the justice system. This is an improper communication with the judge and the judge's use looks like a violation of Rule 3.4(a) of the Model Rules of Professional Conduct.

  • I went to city jail for some bs tickets I would not sign. I sat there for an entire week before they took me in front of the judge, which is in the same building. When asked by the judge I said "Not Guilty". They put me back in jail for another week and took me to the judge a sceond time. When asked I said "Not Guilty". They put me back in jail again for another week before taking me to the judge. When asked I said "Guilty". They told me "no time served, go arrange for payment". WTF???

    That's not a legitimate excuse. Maybe uncooperative but not what you said. I don't know where you were going with that. Complaint is negative feedback. Abusive is taking advantage of a situation. That's technically the reason why officers pull drivers over in the first place. Because they are about to do those things.

  • @badpanda84 - Well then, offer the abuse or lack of compliance as evidence, so both parties will have the opportunity to explain or refute it, if it's even relevant to the charge. Don't hide the fact from the accused as that deprives them of his or her right to a fair trial. This is an abusive of the justice system, such instances have the effect of seriously undermining people's faith in the legitimacy of the system. There is no excuse. This is completely unprofessional.

The fact that they had to use smiley faces or frowning faces is probably a product of necessity because it was the most complicated code that they were able to impart to the degenerates that they had hired to enforce traffic laws in that jurisdiction. However, you are absolutely correct it could have been more stealthy.

    Or maybe it simply was not  intented to be a secert code at all -- after all its no secert what a frowning face means

  • @badpanda84 - Except doesn't it say that the frown was not contained on the copy given to the ticketed driver, only on the carbon copy that was retained by the police officer and then handed over to the judge. Therefore, it would have been a secret to the individual charged. Maybe it's no secret to system insiders but it is fundamentally unfair and amounts to unprofessional conduct by those who have been entrusted to carry out justice in that jurisdiction.

It's misleading, prejudicial and violates the Sixth Amendment's Confrontation Clause. It's fundamentally unfair and a Due Process violation as well. It's the bastardization of the justice system at such a low-level that one must begin to question the entire scheme, especially when judges are shown to be complicit. in this kind of card stacking.

  • @badpanda84 - I wouldn't go that far because it's quite possible to have a secret code that would be visible to the accused in the sense that the piece of evidence was made available to them prior to court, but still remained invisible or at least indiscernible to them because of its hidden and cryptic nature. The behavior of a person in court has no bearing upon a person's behavior at the time the ticket was issued, which is the fact at issue in the case. You'd be making a propensity inference.

To turn your argument around, why not just wait until that person shows up in court and base the discretionary ruling concerning the fine solely upon one's demeanor in court? A defendant has the right to be presented with the evidence against them and to build a case to refute that evidence. Why is that so difficult to understand? It's a main pillar of our legal system.

  • @badpanda84 - In addition, I am quite sure that they are using secret codes and secret surveillance on people all the time and in ways that have far wider reaching implications when it comes to constitutional violations than this simple traffic court case. There are heuristic attempts to catalog, segregate, and control people in many different ways, by various agencies, for a multitude of reasons. It's an absolute disgrace but those responsible remain free to increasingly abuse this power.

  • I find the idea of using a secret code on a ticket that goes directly to a judge in court to be very dishonest. The judges are also invoved in this practice, it's not just the police.

    If the police officer wants to comment on your "attitude" then be honest and open about it. Don't use a secret code. Write it out on the copy given to the person. That allows you to challenge that information in traffic court.

  • @badpanda84 It's not about knowing the code. The defendants did not have a copy of the notes with the smile or frown on it; it was only in the court's file. This was improper ex parte communications, and it should be reported to the State Bar.

  • @krackhed999 Because they are not telling the people who have been issued the ticket about the information. ALL information is supposed to be shared among ALL parties. The prosecution may not have private meetings with judges, and leave the defense out of the conversation. The defense is supposed to have all of the information that the prosecution provides, and the prosecution is supposed to have all the information that the defense provides. The smileys are a violation.

  • The smileys boil down to this... the police are alleging something, and you are not allowed to argue against it. The officer alleges that you were rude, but provides no proof, and you are never allowed to say that officer isn't telling the truth or even attempt to explain your side of the story.

    The judge would react very differently if someone were to say "I'm sorry you're honour. I was being rude, as my wife filed for divorce a week prior to my being pulled over and given a ticket".

  • @elfwall If a judge reacted differently to an explanation like that, the judge needs to be replaced. Police are just doing their jobs when they pull you over and write you a ticket. If you are rude to a police officer because of some personal problem, you need to learn how to control your emotional display. When I go to work, I don't look angry or sad. I don't show frustration with annoying customers. I don't get testy with coworkers. Why? Because I know how to be professional. That's all.

  • @krackhed999 Are you speaking to the people being pulled over, or the officers? I agree you that people should be professional and respectful despite what's going on in their lives. Unfortunately the reality is that neither group is able to do it. Both officers, and the public, occasionally bring their personal issues to the surface during interactions. That does not excuse the officers, judges, and prosecutions ignorance of very simply laws.

  • @elfwall Is there even a law that states smileys can't be written on tickets? I understand that officers should be professional as well, but the general idea that is if you give the officer a hard time, it should be noted regardless of whether or not the ticket receiver is aware. I believe that it is more of a fault on the judge's behalf for not bringing it up during the court session. Although, I also believe it still shouldn't require an explanation from the receiver.

A corporation [corps, dead] can only exist by your time,labor and energy, you give your consent or give up your rights by your signature. they are operating under the U.C.C. [uniform commercial code].which govern the law of the water, therefore they have no Jurisdiction over you or subject matter unless you give it.
