Kaito's not human. He was adopted as a child. There're parts throughout the series like this. When Kaito's paying attention, he begins to drowned underwater because in his mind he's human, and humans can't breathe underwater, so he does not try. But when he's in the heat of the moment and has other things to think about, he can and does breathe because he allows himself to. He's not really concerned with questioning things.
