Black kite boat on port didn't make any move to avoid red on stbd, prompting red to bear away to avoid them (and perhaps make the mark) hitting Kirkland in the process. Still outside the zone, so I'd put blame on black. I'm also not sure I'd give Kirkland much credit for doing an adequate job of keeping clear of red, but don't see what else he could have done at that speed. Ah for an extra half second...
I agree, if the red kite had held their course, Bermuda would have been able to cross clearly on port. It looks like though, if the red kite had waited any longer to dip to get the kite down, they would have missed the mark completely, they just had bad luck on timing there. If they did douse without dipping, they could have wiped out completely! They should have doused earlier.
The red spinnaker boat was in the midst of jibing and therefore was in the wrong. He needed to keep clear and he obviously did not. If he had stood to on the starboard tack, he could have forced the black spin boat to either duck or tack, then he could have tacked to leeward of the black spin boat and called for room at the mark. As it was, even if the red spin boat had not made contact, he was forced to give room at the mark to the black spin boat.

That was Jesse Kirkland who was laid flat, but he's OK. Worst part was going from 5th to 12th.
