Your license lets you play one copy of the game, not the copy on the cart AND a copy you've downloaded, so yes, it's still illegal.

@shadowFlameFable Well you see, R4 is no longer officially supported soooo that means that newer ds games won't load because they have those darned anti-piracy patches. Like in pokemon Heartgold and Soulsilver the game automatically crashes because it's programmed to and newer flashcarts work around this antipiracy, therfore making R4 obsolete. Unless of course you can find an R4 kernel with a workaround(no homo)

I can run any game perfectly using Wood Kernel something, and not the thing that comes with R4 and i run every single game that came out with no problems as well as old ones and i can run as much as homberew i want and emulators with no problem and i prefer downloading a 20 mb game rather than wasting 100 dollars on it.

There are a lots of kernels out there, you just need to google them.
