It doesn't have a fish on, it's attached to the downrigger it's mounted on. It's supposed to be bent over like that. When a fish hits the bait, the clip that holds the line to the downrigger weight pops off and the end of the pole springs up.

If you don't know anything about fishin the don't post comments about it. I'm just sayin. That rod should be like that, because the "bait" is very deep and far from the boat, that's why it looks like it will break soon. But rods are made quite flexible, so it's quite far from the breaking point :)
