Actually, Toy Soldiers is a Martika song that Eminem sampled, so if Britney Spears had ripped off anyone, it would be Martika. Like others have said, though, using the same title isn't ripping anyone off. Check out how many artists have songs called Runaway or Run Away, for example. There are only so many good titles out there.
