  • @bratlert --- A law, as it relates to crime, is any prohibition of any act that also carries with it any form of punishment (monetary fine, restriction of liberty for a specific time, etc.) Prohibition of "J" walking or spitting on the sidewalk define criminal actions. Those two and many others all carried with them some penalty, which if the person accused were found guilty would be required to pay a fine or perform some sort of community service to settle the "debt against society".

  • @Kingery4President If a law is unconstitutional, it was no law to begin with. Law is always about ifs, butts, maybes and it depends.

  • @MrHalified We agree about unconstitutional laws not being laws. Unfortunately too many of them are enforced as if they are.

    IF laws are properly written... that is they are clearly written in simple language: IF the law is vague or confusing it is as much a NON-law as if it were unconstitutional. The only other IF is If the accused person broke that law.

    All that is why the people of 1787 forfeit the only right that completely gave away. Amendment 6 demands Jury trials in ALL criminal cases
