Yes, someone pointed out that the filibuster is useful in stopping the appointment of a bad judge to high court. I still see the filibuster as the difference between what we have done for healthcare and what the other western countries have been able to do. Durbin is talking AGAINST the use of the filibuster by threatening another filibuster.

So, according to you, we should determine policy based on polling data. Therefore, we should not have won the civil war. The vast majority of Americans wanted the war to end and congress was trying to stop it. The big hole in your argument is that the South attacked the United States FIRST at Fort Sumter. THEY were the ones that had declared the war in the first place, so, therefore, anything the U.S. did in response was an act of self-defense. Therefore, you are correct, because most people were against the war it should have stopped. But it was the South who should have stopped the war and surrendered because THEY were the ones who initiated it.
