To be absolutely correct, the Appellate Court (not Obama) has to respond to the Writ of Certiorari; the Appellate Court has to provide the file on this case so that the Supreme Court can begin to determine if it is worth hearing. However, the Writ must be requested by a minimum of 4 Justices. The act of the Writ of Certiorari does not imply any wrong-doing, but is simply a mechanism for transfer of documents.

I read Berg's complaint too. It was an amazing document, even to someone (me) who isn't a lawyer. He was all over the board with his accusations, some of which conflicted with other accusations. It was as if he'd collected every internet rumor ever made on Obama and threw everything at Obama to see if one stuck.

In addition, this definition of NBC is counter to the English common law, upon which the Framers heavily relied.
Thirdly, Wong and Lynch are still good law, and any lower court could not overturn it - SC would be VERY reluctant to hold that very important opinions are overturned, which they would have to do if they defined NBC the way you say they should.

To be absolutely correct, the Appellate Court (not Obama) has to respond to the Writ of Certiorari; the Appellate Court has to provide the file on this case so that the Supreme Court can begin to determine if it is worth hearing. However, the Writ must be requested by a minimum of 4 Justices. The act of the Writ of Certiorari does not imply any wrong-doing, but is simply a mechanism for transfer of documents.

I read Berg's complaint too. It was an amazing document, even to someone (me) who isn't a lawyer. He was all over the board with his accusations, some of which conflicted with other accusations. It was as if he'd collected every internet rumor ever made on Obama and threw everything at Obama to see if one stuck.

The case is still active and the last motions filed were October 22, 2008 .. and Berg is waiting for a summary judgement from the Federal court due to the fact Obama failed to provide his certificate of live birth within 30 days.. DNC and Obama are trying to get dismissal instead of just having Obama providing the ceritficate of live birth (original state stamped and signed copy).
If Obama has nothing to hide.. why all the motions to dismiss and supress?

The law suit was filed in August 2008.
Here we are in October almost November 2008 and Obama has not turned over the original copy of his birth cirtificate to the federal court and the DNC is trying to silence the law suit.
If Obama is a natural born citizen, then why not just turn the original over to the court when the law suit first began so that this issue would have been closed?

And if you'd done some research you would have found that there are statutes in place that prevent the Hawaian government from releasing the documentation that Berg is asking for. The "vault" copy of a birth certificate is protected by laws, and thus the only certificate that Obama would be able to obtain is the one that the FEC, INS, and US State Dept have accepted as being real.

Hawaii doesn't release original long-form birth certificates, only certified copies. One such copy has been available for public scrutiny since at least June.
Also, per Hawaii Revised Statutes 338-13(b), 338-19, the short-form copy is a legal document, including for purposes of establishing citizenship.
Obama has fulfilled his commitment to vet himself to the voters. Stop this farce of justice.
