  • If it was professional, that officer wouldn't have had his weapon drawn. Or would have at least holstered it once the inspection was complete. He was treated like a criminal in this encounter.

Do you think it was appropriate that that same cop wanted to run his ID without probable cause? The officer handling the encounter acted very professional, but I guarantee that if that other officer had been first on scene, events would have gone completely differently.

Criminals make sure to hide all contraband, weapons and money... if you see a person who clearly does not care if you see their weapon, then means they already have nothing to hide and are law abiding citizens.   • I've got a ccw for Missouri and that means you can open carry in parts of the state...loaded....keeping custody of your weapon is YOUR responsibility, not the state's.   • @AnnoyingXboxer Police are not obliged to protect anyone. The point I was trying to make was regarding your comment about it not being safe to carry a loaded gun, yet police do it. So should your same opinion apply to them as well? People carry guns for protection, just like police - there is no difference. However, I do think that anyone who chooses to carry a gun should have proper training and remain proficient with it.

He was obviously, at no time, in this video or any other, appeared to be a threat. Just because he is armed, which in the 2nd Amendment, clearly states we are allowed to BEAR ARMS, doesn't give the cops the right to draw down on just anyone for open carry. I never did, I took my oath to uphold the Constitution, our rights, yours and mine!

  • In a recent newspaper article about this open carry nonsense I noticed the article accompanied a photo of a man waiting in line at a Starbucks with a holstered weapon on his right hip. What truly caught my eye was he was also holding his toddler daughter up to his right shoulder. If this is what you all refer to as "responsible gun owners" then not a one of you has a clue. All it takes is for someone to place their own pistol to the childs head and in the blink of an eye has himseld a new pistol

    I completely understand your argument. The Constitution is the law of the land and should be upheld to the greatest of our ability. The problem is that it has been interpreted in California and gives law enforcement officers a right to search under case law. But i do understand because I do not like to be checked out by the police either. But again, if I saw someone walking in my area with at dark with a gun on his hip, I would want the police to check it out for my family's safety

  • @backpackingnn Yeah, I didn't realize that in CA, open carriers are required to show ID to cops.

    However, criminals don't carry guns outside their clothing, visible, in holsters. They carry their guns concealed, so there's no reason for a cop to question an open carrier. It's a violation of his right, and a waste of tax dollars.

    I would never carry a gun myself, but I think that open carry guys should never have to show anything to cops, because they are no breaking any laws.

  • @1GodOnlyOne Whats the difference between a criminal and a law abiding citizen from the cops point of view? What if a criminal was carrying open, could the cops ID that person? How can the cop tell if the person open carrying their firearm is obeying the law, such as no ammunition in the firearm and/or if they are legally allowed to have that firearm?

  • Suppose open carry does deter criminals more than concealed. If i were a criminal I would sneak up on you because I know to be lawful and have the right to carry open, you won't have any rounds in the chamber. However, if you carried concealed under condition 1 (round in the pipe) that an attack criminal could be confronted very quickly with some unwanted lead.

  • @Smethjt05 In most states, open carriers are not required to show ID to cops unless the cop has a reason to suspect that person of committing a crime. In CA, I just learned, OC's are required to show ID regardless of the fact that they are not committing a crime.

    In most places, if the cop doesn't have reason to suspect you of committing a crime, then he does not have the legal right to demand your ID, and this is as it should be.

  • @locknloadvideo - "Unloaded" open carry is the best possible protection currently provided under unconstitutional California state law. Penal Code 12031 prohibits ammunition from being attached to the firearm in any way. Individuals are allowed to carry live ammunition on their person. This is a perfect example of how our individual right to bear arms has been reduced to the point that law abiding residents' are put at a tactical disadvantage compared to those who choose to break the law.

  • @BayAreaOpenCarry In a way yes, it is a tactical disadvantage for us regular law abbiding, tax paying citizens, but on the other hand I have personally seen people in the range with a pistol strapped to their hip, pull it out, load it, aim, and fire in less than 2 1/2 seconds which is pretty decent. Most thugs and criminals with guns cant hit the side of a barn with a loaded clip and proceed to shoot the pistol side way to look "cool" so in a way its pretty balanced if your trained to the max.

The correct response from McKelvey, however, should have been... "No Officer Gumban I didn't ask for ID because in California peace officers cannot demand ID from individuals who are not breaking the law and acting within their rights."

  • @BayAreaOpenCarry Is it not true that given reasonable cause they can legally I.D. you? Reasonable cause might be something as simple as doing something out of the ordinary... Like open carry. I am all for open carrying of a firearm but I would rather have the police know my name and develop a relationship with them. This would make the future of Open carry a little less threatening to them. once they see you more and more they might just not feel the need to check your weapon, passing by.

    They do not have a right to SEARCH the gun. The law specifically avoids using these terms to make such distinctions vague. An officer MAY INSPECT the weapon to VERIFY that it is unloaded. Either way, an (e)check violates our 4th Amendment rights, and is unconstitutional on it's face.

    Really? Looked perfect? Three officers respond to a call, two of which have guns drawn in low ready gunpoint, for the crime of....what?... grocery shopping? There was NOTHING right about this stop. They knew the open carrier, obviously, from previous encounters (harassment) since they called him by name at the start of the video. There is nothing "perfect" about LE abuse of power against a private citizen behaving LAWFULLY in public. I doubt you'd think it "perfect" had it been you.

  • @420991 - Notice that the first officer on the scene calls the open carrier by his first name. "Walter stop!" Towards the end of the stop one of the officers (who needs additional training on LPD Policy #441) asks, "Did you ID him?" and the ranking officer responds, "That's Walter Stanley." So, at least one officer knew who they were responding to and who had the gun. Beyond that, it's not the officers' duty to know everybody they come into contact with... it's their duty to know the law!

  • they may know who he is, but youre missing the point. as an officer, you NEVER assume that the armed person wont try to kill you. even if you know who they are. you still have to be prepared and anticipate the possibility of that person becoming violent and attempt to shoot you. therefore, as an officer, if you encounter an armed subject, whether you know them or not you tactically should have your hand on your gun, if not having it out at low ready. these officers did nothing wrong.

As an officer you should recognize this & advocate that your fellow officers impartially enforce the law and respect all citizen's rights, as opposed to taking the position that every person is a suspect, or a potential murderer for simply taking the personal responsibility to protect themselves.

  • i fully support open/concealed carry and i do advocate for it. my point is that just because a person utilizes this right doesnt mean they are not a danger to the officer. are 99% of the people we deal with honest, hard working citizens who wouldn't hurt a fly? absolutely. but as an officer you cant let your guard down. when u get complacent and lower your guard because hes just "acting within his rights" you run a higher risk of being attacked. my argument is on officer saftey, not rights

  • @420991 - Your argument is wrong for precisely that reason. LEO safety does NOT preclude my rights. It is LE responsibility to enforce the law and preserve liberty. Not to subvert the law and trample on our liberties. If a LEO cannot handle this responsibility, they need to look for a new line of work. LEOs who draw their guns for the purposes of violating a man's liberty, violating the Constitution to do it, and then claim it was necessary for THEIR OWN safety are not worthy to wear the badge.
