If it was professional, that officer wouldn't have had his weapon drawn. Or would have at least holstered it once the inspection was complete. He was treated like a criminal in this encounter.
@mrbuffer84 Do you think it was appropriate for that cop to brandish his firearm on a citizen that isn't committing a crime? Do you think it was appropriate that that same cop wanted to run his ID without probable cause? The officer handling the encounter acted very professional, but I guarantee that if that other officer had been first on scene, events would have gone completely differently.
I don't think people realize how stupid they are... Criminals make sure to hide all contraband, weapons and money... if you see a person who clearly does not care if you see their weapon, then means they already have nothing to hide and are law abiding citizens. Gun laws are stupid, they are for the benefit of thieves and robbers and prevent law abiding citizens from protecting them selves.
I've got a ccw for Missouri and that means you can open carry in parts of the state...loaded....keeping custody of your weapon is YOUR responsibility, not the state's. @popceed Unloaded so no one can run up and steal the gun from your holster and start shooting people... Unloaded so accidents dont happen.. You can carry a loaded magazine with you, But cannot carry the gun loaded while your walking... I think thats a very understandable rule.

@AnnoyingXboxer Police are not obliged to protect anyone. The point I was trying to make was regarding your comment about it not being safe to carry a loaded gun, yet police do it. So should your same opinion apply to them as well? People carry guns for protection, just like police - there is no difference. Well, if it's common knowledge that plain view guns are unloaded a crimminal can easily relieve you of that property. What are you going to do, say, "WAIT, that's not fair!" ?
so let me ask you people this...if you saw someone walking down your street with a gun, would you not call in and want to have him be checked out? thats what happened, and after being checked out they let him go. nothing wrong, no big deal.
so let me ask you people this...if you saw someone walking down your street with a gun, would you not call in and want to have him be checked out? thats what happened, and after being checked out they let him go. nothing wrong, no big deal.
I completely understand your argument. The Constitution is the law of the land and should be upheld to the greatest of our ability. The problem is that it has been interpreted in California and gives law enforcement officers a right to search under case law. But i do understand because I do not like to be checked out by the police either. But again, if I saw someone walking in my area with at dark with a gun on his hip, I would want the police to check it out for my family's safety
@backpackingnn Yeah, I didn't realize that in CA, open carriers are required to show ID to cops.
However, criminals don't carry guns outside their clothing, visible, in holsters. They carry their guns concealed, so there's no reason for a cop to question an open carrier. It's a violation of his right, and a waste of tax dollars.
I would never carry a gun myself, but I think that open carry guys should never have to show anything to cops, because they are no breaking any laws.
@1GodOnlyOne Whats the difference between a criminal and a law abiding citizen from the cops point of view? What if a criminal was carrying open, could the cops ID that person? How can the cop tell if the person open carrying their firearm is obeying the law, such as no ammunition in the firearm and/or if they are legally allowed to have that firearm?
Suppose open carry does deter criminals more than concealed. If i were a criminal I would sneak up on you because I know to be lawful and have the right to carry open, you won't have any rounds in the chamber. However, if you carried concealed under condition 1 (round in the pipe) that an attack criminal could be confronted very quickly with some unwanted lead.
@Smethjt05 In most states, open carriers are not required to show ID to cops unless the cop has a reason to suspect that person of committing a crime. In CA, I just learned, OC's are required to show ID regardless of the fact that they are not committing a crime.
In most places, if the cop doesn't have reason to suspect you of committing a crime, then he does not have the legal right to demand your ID, and this is as it should be.
a gun has to be unloaded for open carry in LA? also those cops with the guns drawn make me think of the phrase "cleadus, get the damn donut out your mouth"
@EDF6399 In all fairness, the cops received a call that Walter was walking around with his gun out (unfounded, of course). So they naturally treated it as such.
Had it been me I would have addressed the officer who had his gun drawn.. "Excude me officer.. This officer has my gun unloaded in his hand.. d'you mind not pointing your weapon directly at me now? Thanks.." for all the good it would have done.. but I'm a smartass like that. ;)
@locknloadvideo - In California, carrying loaded and drawn can of course be illegal. Therefore, you better be damn sure when you do it that it is absolutely necessary and merely pray that the cops won't charge you, that the DA won't prosecute you, and the jury won't convict you. In addition, if you are in such a situation where you have to load and draw, you may be forced to take a life which generally leads to a civil lawsuit against you which will cost a minimum of $50,000-100,000 and millio
@AnAextoGrind good point. I by no means think the war is a good idea especially after this long but someones has to stand up and put there life on the line so thank you
If the people of California do not have the right to carry LOADED, How can cops carry loaded??... when they derive their authority from those same people they stop and harass to see if it is loaded?
Good luck to you in CA in getting your rights back.
I...Heart.. UTAH
I open carry on a regular basis....Oh' and Yes! It is loaded! It's a gun for heavens sake... not a boat anchor.
@locknloadvideo - "Unloaded" open carry is the best possible protection currently provided under unconstitutional California state law. Penal Code 12031 prohibits ammunition from being attached to the firearm in any way. Individuals are allowed to carry live ammunition on their person. This is a perfect example of how our individual right to bear arms has been reduced to the point that law abiding residents' are put at a tactical disadvantage compared to those who choose to break the law.
@BayAreaOpenCarry In a way yes, it is a tactical disadvantage for us regular law abbiding, tax paying citizens, but on the other hand I have personally seen people in the range with a pistol strapped to their hip, pull it out, load it, aim, and fire in less than 2 1/2 seconds which is pretty decent. Most thugs and criminals with guns cant hit the side of a barn with a loaded clip and proceed to shoot the pistol side way to look "cool" so in a way its pretty balanced if your trained to the max.
@locknloadvideo - I am wondering - I can see that open carry can be a deterrence - but as far as in the eveny you are threatened by a life threatening situation - what good is an unloaded handgun - can you carry a separate loaded clip in another pocked that has ammunition in those just in case situations.
@locknloadvideo You can carry live ammunition with you it just can't be in the firearm you put it on the other side of your hip in the magazine and have it ready to go. At least you'll have a fighting chance against someone who threatens you then you would without a gun in general
You just let those losers put, not one, but two guns on you. I'll be God damned if I'd sit there and look down the barrel of two civil servant's pistols. Of course, you're dumb enough to live in California; so you effectively brought this treatment on yourself.
To see more open carry vids, specifically about the lengths to which New Hampshirites are willing to go for gun freedom, click my channel. Or search "Ridley Report open carry."
Although 'Open Carry' is recognized by LEO in California, doesn't it seem awkward that the weapon would be illegal if it was loaded? What good is your weapon if it's not loaded? What are you supposed to do, tell the gang banger who's threatening you with his loaded gun to wait while you load your weapon? I'm so glad to be an ex Californian and living in a state where the politicians and LEO's have some common sense.
Love it! Trained PROS who can use their guns 4REAL, drawing on &checking sum strutting, brokedick cowboy, who carries his gun around, PRETENDING 2B SOME AIRDICK AMERICAN HERO. Good work guys. Keep harassing &making life as UNCOMFORTABLE AS POSSIBLE for these d-bags. They need a lesson about the broader importance of public saftety &COMMON SENSE, trumping the "rights" of sum tinhorn JACKASS, walking around w/a deadly weapon, bcuz it makes HIM feel like a, 'Moonshine Superman'. Fuck OC cowards.
SafewaySecurity -After listening to the audio once again, I believe Officer McKelvey responds, "That's Walter Stanley" when Officer Gumban asks, "Did you ID him?" The correct response from McKelvey, however, should have been... "No Officer Gumban I didn't ask for ID because in California peace officers cannot demand ID from individuals who are not breaking the law and acting within their rights."
@BayAreaOpenCarry Is it not true that given reasonable cause they can legally I.D. you? Reasonable cause might be something as simple as doing something out of the ordinary... Like open carry. I am all for open carrying of a firearm but I would rather have the police know my name and develop a relationship with them. This would make the future of Open carry a little less threatening to them. once they see you more and more they might just not feel the need to check your weapon, passing by.
Don't know if anyone heard this part.. but one of my astute forum mates pointed out at the end of the video one of the cops ask "Did you ID him?" "He had the camera on..." So they would have violated his rights and asked him for his 'papers' if the camera wasn't on?
hey 420991, I understand what your saying but, remember to never assume that the legal citizen that now has a light in his face and has a person coming up on him with gun drawn doesn't defend himself because he may think that person is trying to kill him. the officer could have still done his job wthout creating so much drama and treating him like a criminal. remember cops carry open to. maybe a light in there eyes with gun drawn on them would shed some light on the situation. I think not.
@caldigger - Yes he did. To which the other officer replied, "That's Walter Stanley." A VERY well known advocate and activist in the CA OC movement. This is harassment, plain and simple.
BART pigs killed unarmed Oscar Grant for nothing and basically got away with it. I'd be careful, you might end up being next. These Livermore pigs look like they're just waiting to gun your ass down. Seems like a scene out of NAZI Germany. In AZ nobody would even think twice. Amazing
that wasnt that bad of a stop for obamafornia. thing is enough of us dont exorcise our open carry so they arent used to it. i would be more leery of the guns we dont see though...
@RLCCA - It certainly IS a blatant violation of the 4th Amendment, but that matters little to the Rogue Legislature of California. The Constitution has no meaning to them. Or authority. It's merely something for them to circumvent.
rubbish, people are open carrying all over the united states- cops need to stop overeating. the way CA cops are reacting is no different then the way they used to if an interracial couple or gay people were walking holding hands.
We here, were armed, get used to it!
Why do CA cops need to freak out when cops in Oregon/AZ/NV don't need to freak out?
"Bearing Arms" is in the freaking Constitution, try obeying the law officers-please.
You shouldn't have answered any of their questions... I like how at the end they were like " Did you ID him?" When he clearly called you by name which would mean they would just wan to harass you further. They also prolly don't know that California requires officers have probable cause in order to make you ID yourself.
I havent had guns drawn on me yet for OC but I hav ehad a few encounters of my own that i got on tape. Check out my channel.
What makes me heated is the fact that they can draw there firearm when they feel threatened by us but if u even think of touching your gun your gonna be swiss cheese.
You handled it well. Hopefully the police officers will learn to just tell the caller that OC is legal. I liked how one cop asked "did you ID him?" No, no ID necessary officer. I respect the police, but I also want them to grow accustomed to law abiding armed citizens.
They do not have a right to SEARCH the gun. The law specifically avoids using these terms to make such distinctions vague. An officer MAY INSPECT the weapon to VERIFY that it is unloaded. Either way, an (e)check violates our 4th Amendment rights, and is unconstitutional on it's face.
Really? Looked perfect? Three officers respond to a call, two of which have guns drawn in low ready gunpoint, for the crime of....what?... grocery shopping? There was NOTHING right about this stop. They knew the open carrier, obviously, from previous encounters (harassment) since they called him by name at the start of the video. There is nothing "perfect" about LE abuse of power against a private citizen behaving LAWFULLY in public. I doubt you'd think it "perfect" had it been you.
This comment has received too many negative votesshow
@JSMan55 officers get a call of a man with a gun walking down the street. they dont know who theyre responding to or who has the gun. when dealing with people with guns, legally or not, you always have to treat them like they want to kill you. you never drop your guard. having the guns out at low ready, on a gun call, is an officer saftey measure just in case the citizen decides he wants to kill the officers. you never know what someone is going to do, they were just being prepared
@420991 - Notice that the first officer on the scene calls the open carrier by his first name. "Walter stop!" Towards the end of the stop one of the officers (who needs additional training on LPD Policy #441) asks, "Did you ID him?" and the ranking officer responds, "That's Walter Stanley." So, at least one officer knew who they were responding to and who had the gun. Beyond that, it's not the officers' duty to know everybody they come into contact with... it's their duty to know the law!
they may know who he is, but youre missing the point. as an officer, you NEVER assume that the armed person wont try to kill you. even if you know who they are. you still have to be prepared and anticipate the possibility of that person becoming violent and attempt to shoot you. therefore, as an officer, if you encounter an armed subject, whether you know them or not you tactically should have your hand on your gun, if not having it out at low ready. these officers did nothing wrong.
@420991 - If anybody seems to be missing the point, it's you sir. The individual in the video was in compliance with the law and acting within the rights you yourself have sworn to "support & defend." As an officer you should recognize this & advocate that your fellow officers impartially enforce the law and respect all citizen's rights, as opposed to taking the position that every person is a suspect, or a potential murderer for simply taking the personal responsibility to protect themselves.
i fully support open/concealed carry and i do advocate for it. my point is that just because a person utilizes this right doesnt mean they are not a danger to the officer. are 99% of the people we deal with honest, hard working citizens who wouldn't hurt a fly? absolutely. but as an officer you cant let your guard down. when u get complacent and lower your guard because hes just "acting within his rights" you run a higher risk of being attacked. my argument is on officer saftey, not rights
@420991 - Your argument is wrong for precisely that reason. LEO safety does NOT preclude my rights. It is LE responsibility to enforce the law and preserve liberty. Not to subvert the law and trample on our liberties. If a LEO cannot handle this responsibility, they need to look for a new line of work. LEOs who draw their guns for the purposes of violating a man's liberty, violating the Constitution to do it, and then claim it was necessary for THEIR OWN safety are not worthy to wear the badge.
If it was professional, that officer wouldn't have had his weapon drawn. Or would have at least holstered it once the inspection was complete. He was treated like a criminal in this encounter.

@backpackingnn Open carry is illegal in my state, so yes, I would call.
If I lived in a state where open carry was legal, then no, I would not call.
Would you call the police on someone who broke no laws?
Would you want to be detained and illegally searched by the police even though you broke no laws?
1GodOnlyOne 10 months ago
@1GodOnlyOne
I completely understand your argument. The Constitution is the law of the land and should be upheld to the greatest of our ability. The problem is that it has been interpreted in California and gives law enforcement officers a right to search under case law. But i do understand because I do not like to be checked out by the police either. But again, if I saw someone walking in my area with at dark with a gun on his hip, I would want the police to check it out for my family's safety
backpackingnn 10 months ago
@backpackingnn Yeah, I didn't realize that in CA, open carriers are required to show ID to cops.
However, criminals don't carry guns outside their clothing, visible, in holsters. They carry their guns concealed, so there's no reason for a cop to question an open carrier. It's a violation of his right, and a waste of tax dollars.
I would never carry a gun myself, but I think that open carry guys should never have to show anything to cops, because they are no breaking any laws.
1GodOnlyOne 10 months ago
@1GodOnlyOne Whats the difference between a criminal and a law abiding citizen from the cops point of view? What if a criminal was carrying open, could the cops ID that person? How can the cop tell if the person open carrying their firearm is obeying the law, such as no ammunition in the firearm and/or if they are legally allowed to have that firearm?
Smethjt05 10 months ago
Suppose open carry does deter criminals more than concealed. If i were a criminal I would sneak up on you because I know to be lawful and have the right to carry open, you won't have any rounds in the chamber. However, if you carried concealed under condition 1 (round in the pipe) that an attack criminal could be confronted very quickly with some unwanted lead.
Smethjt05 10 months ago
@Smethjt05 In most states, open carriers are not required to show ID to cops unless the cop has a reason to suspect that person of committing a crime. In CA, I just learned, OC's are required to show ID regardless of the fact that they are not committing a crime.
In most places, if the cop doesn't have reason to suspect you of committing a crime, then he does not have the legal right to demand your ID, and this is as it should be.

josacape 1 year ago
@locknloadvideo - In California, carrying loaded and drawn can of course be illegal. Therefore, you better be damn sure when you do it that it is absolutely necessary and merely pray that the cops won't charge you, that the DA won't prosecute you, and the jury won't convict you. In addition, if you are in such a situation where you have to load and draw, you may be forced to take a life which generally leads to a civil lawsuit against you which will cost a minimum of $50,000-100,000 and millio

Unloaded? Wtf kinda good does that do?
locknloadvideo 1 year ago
@locknloadvideo - "Unloaded" open carry is the best possible protection currently provided under unconstitutional California state law. Penal Code 12031 prohibits ammunition from being attached to the firearm in any way. Individuals are allowed to carry live ammunition on their person. This is a perfect example of how our individual right to bear arms has been reduced to the point that law abiding residents' are put at a tactical disadvantage compared to those who choose to break the law.
BayAreaOpenCarry 1 year ago 36
@BayAreaOpenCarry So what if you have to load it do defend yourself? Is that breaking the law?
locknloadvideo 1 year ago

@BayAreaOpenCarry Is it not true that given reasonable cause they can legally I.D. you? Reasonable cause might be something as simple as doing something out of the ordinary... Like open carry. I am all for open carrying of a firearm but I would rather have the police know my name and develop a relationship with them. This would make the future of Open carry a little less threatening to them. once they see you more and more they might just not feel the need to check your weapon, passing by.

hey 420991, I understand what your saying but, remember to never assume that the legal citizen that now has a light in his face and has a person coming up on him with gun drawn doesn't defend himself because he may think that person is trying to kill him. the officer could have still done his job wthout creating so much drama and treating him like a criminal. remember cops carry open to. maybe a light in there eyes with gun drawn on them would shed some light on the situation. Do they have the right to verify if the gun is unloaded in California? You handled that perfectly.
nmbrone 1 year ago
@nmbrone
yep. they don't have the right to just search your entire body, just search the gun to verify that its unloaded.
stixs2005 1 year ago
@stixs2005
JSMan55 1 year ago
@nmbrone In CA, it has to be unloaded, but mag's can be carried.
kinney2040 1 year ago
@nmbrone Under California Penal Code 12031 (e) check, offices can verify if the firearm is unloaded. There should be no search of the serial number.
nelsonboy707 1 year ago 2
are you saying the officers did something wrong? looks perfect to me. not harrassment, just them checking on a call
420991 1 year ago
@420991
JSMan55 1 year ago
This comment has received too many negative votes show
@JSMan55 officers get a call of a man with a gun walking down the street. they dont know who theyre responding to or who has the gun. when dealing with people with guns, legally or not, you always have to treat them like they want to kill you. you never drop your guard. having the guns out at low ready, on a gun call, is an officer saftey measure just in case the citizen decides he wants to kill the officers. you never know what someone is going to do, they were just being prepared
420991 1 year ago
@420991 - Notice that the first officer on the scene calls the open carrier by his first name. "Walter stop!" Towards the end of the stop one of the officers (who needs additional training on LPD Policy #441) asks, "Did you ID him?" and the ranking officer responds, "That's Walter Stanley." So, at least one officer knew who they were responding to and who had the gun. Beyond that, it's not the officers' duty to know everybody they come into contact with... it's their duty to know the law!
BayAreaOpenCarry 1 year ago 11
they may know who he is, but youre missing the point. as an officer, you NEVER assume that the armed person wont try to kill you. even if you know who they are. you still have to be prepared and anticipate the possibility of that person becoming violent and attempt to shoot you. therefore, as an officer, if you encounter an armed subject, whether you know them or not you tactically should have your hand on your gun, if not having it out at low ready. these officers did nothing wrong.
420991 1 year ago
@420991 - If anybody seems to be missing the point, it's you sir. The individual in the video was in compliance with the law and acting within the rights you yourself have sworn to "support & defend." As an officer you should recognize this & advocate that your fellow officers impartially enforce the law and respect all citizen's rights, as opposed to taking the position that every person is a suspect, or a potential murderer for simply taking the personal responsibility to protect themselves.
BayAreaOpenCarry 1 year ago 20
i fully support open/concealed carry and i do advocate for it. my point is that just because a person utilizes this right doesnt mean they are not a danger to the officer. are 99% of the people we deal with honest, hard working citizens who wouldn't hurt a fly? absolutely. but as an officer you cant let your guard down. when u get complacent and lower your guard because hes just "acting within his rights" you run a higher risk of being attacked. my argument is on officer saftey, not rights
420991 1 year ago
@420991 99% of the people pigs deal with wouldn't hurt a fly, but your position is to treat everyone like a murderer. Your argument is dog shit!
LIBERTYORDEATH2008 1 year ago
@420991 - Your argument is wrong for precisely that reason. LEO safety does NOT preclude my rights. It is LE responsibility to enforce the law and preserve liberty. Not to subvert the law and trample on our liberties. If a LEO cannot handle this responsibility, they need to look for a new line of work. LEOs who draw their guns for the purposes of violating a man's liberty, violating the Constitution to do it, and then claim it was necessary for THEIR OWN safety are not worthy to wear the badge.
