Koh's own statement from Congressional Quarterly:

"They are only binding in our court, international and foreign law, when judges make them so, the president suggests that they should be so, or Congress embodies them into an act of Congress thats signed by the president . . . . International and foreign law dont become our law unless they are brought into our law by an act of American legal institutions."

Yes, and if you weren't shockingly ignorant of how the American legal system works you would know that that is a mainstream statement.

Presidents signing on to treaties and their subsequent ratification makes them binding upon the US. Judges cite international law quite commonly. In fairness, Scalia hates it any time that happens, but he's pretty much an exception to the general rule that international law, while not forming the sole basis of a holding, can be cited in support of a decision.

This video did not cite any evidence or quotes to back up his assertion that Koh is some uber-liberal except for the fact that he says so. Koh was endorsed by the Yale Republicans, Ken Starr and Ted Olson, some of the most public conservative legal scholars in the country.

Asserting that something is true does not make it true.
