ALL air travel in US air space must have approved flight plans with the FAA, ONLY aircraft operating in military airspace are exempt. The FAA has oversight of civilian air space and NORAD over military air space. If FAA controllers can't ID a flight, it is routed to the nearest Air National Guard unit (and NORAD) for interception. All of the 911 flights had approved flight plans, which is not NORAD's mission.

As far as your charge about not getting a "fair trial" -- then HOW did any of them get acquitted of the charges against them?

The sixth amendment applies to anybody who is held under United States law which includes foreign nationals taken off of the "field of battle" and put into an American prison like gitmo. Though the detainees at Guantanamo were not all taken from the "field of battle." Many were taken from their homes.
Compared to the number of detainees, very very very few of them were acquitted. Many of them have been there for years without a trial.
DriveByTroll, check the Sixth Amendment again, it does not apply to "enemy combatant" as described in the Congressional authorizations for military action. These detainees fall under the jurisdiction of military law under the Executive Branch as authorized by Congress. The SCOTUS does not apply to these detainees. This is why Obama doesn't know what to do with them, because he has no military legal experience or service background.

I don't know why the U.S. Congress has refused to suspend habeas corpus, but they clearly have the power to do so (just as they have the right to define federal jurisdiction). Perhaps they were simply trying backstop measures before instituting an alarming suspension for the first time since WWII.

Saddam Hussein had used both biological and chemical weapons in the past and was staged to use them against coalition forces in 1991. This was one of the reasons why the Coalition Forces did not overrun Iraq. Saddam's disarmament of WMD was to be done under UN inspection under a diplomatic accord, which he continued to violate until he was deposed. Some WMD were found, but the press didn't care.

The question is whether the methods used are immoral, which if you believe they are, means you believe there is a transcendent right and wrong, that there is a greater good that needs to be observed. The TSA predated the DHS by a year, because the Bush administration finally discovered that the US intelligence agencies would not share information in a cooperative and effective manner, so DHS reorganized their focus and now pulls them in a cooperative manner.

Profiling programs run by the airlines in conjunction with the FAA (that I won't discuss here) were implemented after the hostage situations of the 1980's to Pan Am and other U.S. carriers. It was this program that alerted the AA ticket agent that Mr. Ata was a terrorist, unfortunately she was not listened to.

ALL air travel in US air space must have approved flight plans with the FAA, ONLY aircraft operating in military airspace are exempt. The FAA has oversight of civilian air space and NORAD over military air space. If FAA controllers can't ID a flight, it is routed to the nearest Air National Guard unit (and NORAD) for interception. All of the 911 flights had approved flight plans, which is not NORAD's mission.

7 and a half years of peace and quiet in this country is not an accident it is an accomplishment. If depriving the peaceful sleep of 20 terrorists and simulating(not actually doing it but simulating it) drowning saves the life of even one American child it is justified. The FACT that it has saved not just one but countless lives is all more the reason to continue the policies that have proven to work and keep this country safe.

Speedy and Fair Trials are the sole right of American Citizens protected by the U.S. Constitution. The U.S. Constitution does NOT apply to non-citizens, and it definitely doesn't apply to foreign nationals who are taken into custody on the field of battle. I notice Obama doesn't mention the recidivism rate of those who were released... As far as your charge about not getting a "fair trial" -- then HOW did any of them get acquitted of the charges against them?

You couldn't be more incorrect. The sixth amendment applies to anybody who is held under United States law which includes foreign nationals taken off of the "field of battle" and put into an American prison like gitmo. Though the detainees at Guantanamo were not all taken from the "field of battle." Many were taken from their homes.
Compared to the number of detainees, very very very few of them were acquitted. Many of them have been there for years without a trial.

DriveByTroll, check the Sixth Amendment again, it does not apply to "enemy combatant" as described in the Congressional authorizations for military action. These detainees fall under the jurisdiction of military law under the Executive Branch as authorized by Congress. The SCOTUS does not apply to these detainees. This is why Obama doesn't know what to do with them, because he has no military legal experience or service background.

I don't know why the U.S. Congress has refused to suspend habeas corpus, but they clearly have the power to do so (just as they have the right to define federal jurisdiction). Perhaps they were simply trying backstop measures before instituting an alarming suspension for the first time since WWII.

2. Congress can and did suspend Habeus Corpus, but when habeus corpus wasn't suspended Gitmo still held detainees without just cause. This would be illegal.
4. Waterboarding was never made legal, but it was done anyways.
Nobody should operate outside of the law and get away with it. Period.

Medah, WMD doesn't only mean nuclear, its all of NBC warfare (Nuclear, Biological and Chemical). Saddam Hussein had used both biological and chemical weapons in the past and was staged to use them against coalition forces in 1991. This was one of the reasons why the Coalition Forces did not overrun Iraq. Saddam's disarmament of WMD was to be done under UN inspection under a diplomatic accord, which he continued to violate until he was deposed. Some WMD were found, but the press didn't care.

You missed the core of my comment. It was Adm Blair (the missing 26 words) and George Tenant who said the info was invaluable. And to be fair, that is not the main point, though it is the pragmatic point. The question is whether the methods used are immoral, which if you believe they are, means you believe there is a transcendent right and wrong, that there is a greater good that needs to be observed. In effect, you are saying Cheney's morality is wrong to save 1000s of lives- it is not.

To your amazement I would say no to torture for two reasons.
1st, There are many ways to find information without lowering myself and everyone around me to dirt level.
2nd and most important (this is what makes it a good question). I would not torture because I would have to choose between the constitution/law and my personal feelings. I don't have the right to bend the law for my feelings.
