It used to be. Ryan went back to Flaw who are currently having a struggle for their own name because of legal bullshit so BMH can't actually claim the "Including ex-members of Flaw" anymore which to me is very sad.

Well Max already stated awhile ago that 40 Below Summer will still be around but only to record albums and such. Black Market Hero is their main focus right now so they'll be the ones touring and recording more of the time. It's kind of an odd thing becuase the line-up for both bands only differ's in two members. It's an oddball of a story but it's about a name respect issue because without those two members it's not really 40 Below Summer.

They did but it was more of a sampler that came with their merch on their myspace page. It has like six or seven songs they recorded. I don't kno whether you can still get on though but some of it is available on iTunes.

No, this was the original 40 Below Summer before the merger. Currently Ryan Juhrs is with Flaw so we can't really say that merger exists anymore. But Black Market Hero basically is 40 Below Summer re-invented.
