If you want Apple to replace your jail-broken iPod, you must perform some steps before doing the actual 'jail-breaking'. You need to have a copy of the uncorrupted firmware from Apple. It must be undistorted, and unedited. Also - you need to find some way to install this software before you send it back in. If you do send it in jail-broken, and they do find out - they will NOT service your iPod.

then what i did was went to argos and told them whatever lie and they replaced my ipod without asking any question.

they asked me would you like to get your money back on replace the product and i said replace then in 5 mins i got a brand new ipod touch 3g 64gb in my hand

I don't believe so, i guess it won't hurt to call apple and see if they'll replace it but i'm almost positive that the warranty only covers the hardware so if it malfunctions they'll replace it if not, your kinda screwed. Since you restored it they won't be able to tell it was jailbroken.

you can but you need to do something called a tetherd jailbreak and if you heard tethering a phone before it really means just running something off the ipod on the computer or somethinf from the computer on the ipod touch or iphone when it's connect ted through the usb cord and it's like a string is tetherd to a ball of felt and when you jailbreak the ipod when you restart it you will have to jailbreak it again

actualy if your ipod has a technical software problem then they check all internet and downloaded files added to your device. If they find jailbreaking software on your device they have legal rights to put your ipod into holding until you pay full for the device or pay for a bill or ticket. If the problem is anything else it will not void the warranty. Jailbreaking is not illgeal but against apples rules of service.
