The law is the Geneva Conventions. When the ICRC, acting in its capacity as the arbiter of Article 3 of the Geneva Conventions, says it's torture, it's torture.

corbyz.. Waterboarding is not Torture according to the Geneva Convention. As a Combat Vietnam vet I can attest to what torture is and what it is not. Under the GC a person not in Uniform caring a weapon can be shot as a SPY! Also if a POW escapes and kills a guard if he is recaptured he can be shot dead! Torture is where the victim is maimed, cut, or beaten to the point of being maimed. Waterboarding is not torture! It may be Abuse but it doesn't fall under the Geneva Conventions rules of war.

President Obama sadly called off the prosecutions of the members of the Bush Administration. However, the ACLU is still fighting for prosecutions, and hopefully they go all the way!

The Justice Department can still prosecute, whether the President likes it or not. The only way Obama can make sure these guys aren't held accountable is to pardon them.

RURIGHT, I thought the law was the law, and no one had a free pass. It's not optional whether or not you enforce these laws. It is literally an actual war crime. If we don't hold people accountable, then we're saying we punish traffic violations more harshly than we punish torture... then we have no moral high ground on which to stand and tell others that they can't do these things.

The IRC is not the Org that dictates what the "Rules of War is! Ask a Muslim what he thinks of the Red Cross? They would ask the "Crescent Moon"! As I stated before, Water boarding is not torture! They were not Maimed or cut or bruised in any way! You can call it abuse but not torture! Under the Geneva Convention they could have been shot dead on the battlefield. All Soldiers MUST wear a FLAG on their shoulders! Otherwise they are considered spies or nonaligned combatants and shot dead! POW!

As you stated before... waterboarding is not torture. But that's just your opinion. The law dictates that the Red Cross is the decider of what is and is not torture. The Red Cross says that waterboarding is torture. The law says that torture is a war crime. Your opinions on the matter and twisted attempts at logic do not change the law. And you're still a sick sadist for defending waterboarding, whether you think it's torture or not. Seek help and stay away from children.
