It comes time for orochimaru to take sasuke's body. But sasuke doesnt want him to and sasuke still has to kill his brother, so they fight and sasuke wins, after that he makes the four man cell called HAWK which contains sasuke,suigetsu,karin and juugo.

but you forgott a scense in the battle sasuke vs itachi, orochimaru come out from sasukes´s body and than he try to kill itachi for sasuke but itachi kill orochimaru and than he died because itachi was sick or anything like this, and he was get hidden by kirin (technique by sasuke)
