Psytar lost the summary judgement in California. What they're doing IS illegal, it's against the EULA and against the DMCA. Apple doesn't really care so much about OSX86, it's a personal project. There's a MASSIVE difference between "for personal use" and actually SELLING it. What Psystar are doing is 100% illegal, even in the EU it would be illegal. Commercial and personal are NOT the same thing. It's like copying a CD for personal back up, that's fine, but if you sold those copies, illegal.
I'm with all the other hackintosh users they are fun, and I never call tech support for my PC so why the hell would I call them for my hackintosh ? I don't update my Linux, or Windows any more it always causes problems... so I wouldn't update Psystar... :D
There is also PearPC , vmware, and osx86project ... And some other Virtual software that runs Mac OS on PC .... YES they all work... but no most of them you can't up date... or shouldn't ...
I had a AMD hackintosh for long time it ran fine it now runs Dream Linux because I see no benefit of OSX over Linux when Linux is just as good if not better and its 100% free and legal.
As for psystar, you can run OSX on a $200 netbook if that was your thing and for cheaper.
hackintoshes are fun to use, you can get a taste of Mac OSX. But its not reliable. You either need to make backups constantly or just save money and buy a Mac.

Apple is gonna have some trouble winning this case. It's actually illegal to sell any OS as a standalone because it's illegal in many countries to sell a license to buy something.
OS X only runs on a fairly limited set of hardware, which means the hardware in a hackintosh has to be fairly close to what's in an actual Mac; so, the argument that hackintoshes are less stable than actual Macs doesn't really make sense to me. Also, since Macs use USB and PCI, pretty much any company can make a device for a Mac. So the argument about "no driver hell" on a Mac doesn't really hold water.
my sentiments exactly...currently testing a hackintosh on a buddies computer and it was built with hardware that supports efi...basically a mac config that is upgradable...if you take the time and get the right parts keeping to usb and pci you can install vanilla kernals and update using the mac website ;)...the hackintosh should be identical to a mac after that...
I'd need to see this product out for a year before I feel its vetted enough to buy it. And the crazy thing is, who knows if Psystar will even be around in a year?

What most forget they aren't only messing with Mac, they are messing with EFI as well. Emulating EFI is blatantly copying them. I've seen Hackintoshs and they barely work at best. As buffa said any updates will break the machine.
It's nowhere near illegal actually. The EULA is just an agreement between Apple the the user. It is not a controlled by legal forces. The only thing they could get in trouble for, is providing pirated Mac OS X, or using the name OpenMac, which is why they changed the name to Open Computer, and they provide a purchased retail version of Mac OS X. lt runs a Vanilla kernel, which means that the OS will need no patching to run, the Machine will think its a real mac, and updates will work fine.
They just want to get some attention and so far they're doing a pretty god job. They know it's illegal, the whole "monopoly" crap is just an excuse to make it a big deal. In the end, they'll stop claming that they can ship pcs with osx preinstalled and they will be simply known as a pc maker company... pcs that can run osx!

One of the reasons Apple doesn't allow Third Party hardware, is that it causes problems. OSX works so well because Apple knows the exact system setups that exist, they don't have to cater for 100s of different hardware combinations, from different manufacturers, in the way that Microsoft does.
Why would Apple want to follow the 'make the OS work on any system' path that Microsoft went down? It's not going to well with Vista at the moment is it! I gave up on Windows at 98SE, never regretted it.
my three personal machines including a toshiba laptop took the vista upgrade with no trouble at all. systems were two years to three years old at the time. the drivers that vista didnt have for my comps , promptly were downloaded by vista and installed. its not as bad as some people make out. im having no trouble at all with a very wide range of hardware.
This is bad news for hackintosh users like us...we keep discrete about hackintosh..but this Psystar bullshit takes advantage of it...now apple will be aware of this and tighten their OSX security not to run in non apple hardwares!!
Apparently the psystar website was down for a few hours and when it went back online it was no longer OpenMac but Open Computer. So I'm assuming some legal actions have been threatened/taken.

actually breaking the eula is illegal, as the eula is what allows you to make a copy (I.e install the software).
When you break the eula, copyright law means you can't install or use it.

psystar are charged since they are modifiing the OS. that is however illigal for sales.
If the machine is "capable" of OSX and the osx sold seperatly there is no problem.
But psystar are running on a modfied kernel.

Now that Macs run on intel chips there is no magic "Mac Hardware" that Mac OS X needs to run smoothly on.
I LOVE OS X but if it can be run on something that is $5-600 cheaper than I'd gladly get one.
One problem with this open mac is that judging from the video I saw it's pretty damn loud.
as for updates, I'd be fine without them. I've only done 1 update in about a year

i already got a macbook pro and a desktop that quad boots vista, xp, ubuntu, and mac os x leopard. leopard runs flawlessly for me on my hackintosh
