  • They can demand your insurance ID without probable cause... So if you are driving, can they demand to see your license for no reason?

    Also, don't ever resist or disobey when they're arresting you; later in court you will be seen as the guilty one, and will lose any case you could have had against them. It certainly won't make them stop arresting you. And - as you can see in this video -- they will use that as the primary reason for arresting you in the first place, illogical as that is.

  • @DominicMetal1979: AFIK, all states have laws stating that drivers must show drivers license, registration, and proof of insurance to police officers on demand, when enforcing traffic laws.

    The catch is that the U.S. Constitution limits police on when they may STOP a driver, and punishes the State for violations by exclusing evidence found after an unconstitutional stop.

    The issue here is whether the police legally stopped her, such as at a constitutional checkpoint. See Michigan v. Sitz.

  • I think you are mistaken. when asked to present a valid drivers license you are required to do so. you do have rights and at best most times they are honored but you do not have a right to deny an officer of the law when required to show a valid permit to operate a motor vehicle on a public street.

    Considering that the federal government has more than 300,000 laws and regulations, I suggest that no one can ever learn all the federal laws. I doubt that anyone can even learn all the state laws. A law school teaches people to think like a lawyer (no easy task), rather than teaching all laws.

  • @jamescgale: Officers should have a reasonable and articulable suspicion that a person is an illegal immigrant before asking the person about their citizenship. That is part of people's rights under the Fourth Amendment - to be free from unreasonable detentions.

Ohio, 392 U.S. 1 (1968) which started what is known as a terry stop and frisk. which has just recently be extended to a person vehicle. it includes the areas in reach of persons inside. this law was put into place for officer safety. also in the begining the 2nd officers was stopping other cars. once there became a problem the 2nd officer moved over to assist. Most cops are good people just trying to do a job and protect people. What was the big deal about showing her ID anyway?

Then click on '2008 Term Opinions of the Court'. Then search for 'Gant'. You will find that once a suspect is safely removed from a vehicle, only two reasons justify searching the vehicle. THIS video demonstrated neither reason. This search was illegal.

    My understanding is that she was pulled over after turning to avoid a checkpoint. Doing so is perfectly legal so the officer did not have reasonable suspicion if this is so. Reports from the court case support this theory.

  • @Pafoofnik1 i don't know the exact situation, they said she was like reading on the side of the road or something. but if the cops ask your name and you absolutely refuse to give it, you're likely going to jail. those cops were power tripping but so was she. you have to prove that you have been granted the priviledge to drive.

  • @DavidForthoffer the fine for driving without a liscense is 50 in my state. and if one does not have ID when the officer asks, then they must hold you in jail until your identification is confirmed. failing to produce ID when asked even without probable cause is considered unlawful insurbordination. but most cops have better things to do.

  • if the woman in the video showed ID, she probably would have been on her way. but i do see the point made that the police can force citizens to curb their liberties and rights. the police have advantage because the encounter is immediate, they have immediate control. and the theoretical control that the citizen holds could be utilized in court at a later time in the citizens favor. police abuse is a loophole that cause citizens grief, even though citizen likely wins in the end.

  • @admiralct evidently not ALL cops have better things to do. not all states are "stop and identify" states. in "stop and identify" states, they can only demand your identification if you're being charged with a crime. identification means telling them who you are, NOT showing a physical ID card. what crime was this woman suspected of?

  • @chieftp: Actually, in "stop and identify" states such as Nevada, they can stop you if the have a reasonable and articulable suspicion that you are involved in criminal activity, which is a lower standard than charging with a crime. See Hiibel v. Nevada. For example, you can be completely innocent of anything, but if your description and car match that of a wanted felon, you can be stopped. Then, in such states, you can be arrested for failing to identify yourself.

    But even though many states have laws requiring drivers to show their drivers licenses to police officers on demand, it is nevertheless illegal (unconstitutional) for police officers to arbitrarily stop drivers in the first place.

    The consequence of officers finding evidence of crimes after behaving unconstitutionally is that the evidence must be suppressed, though lower courts often trample over people's rights anyway.

    All the states I've researched have laws making it a crime to obstruct an officer in the performance of their duty.

    Since officers NEVER have a duty to violate a person's constitutional rights, then exerting your constitutional rights is not obstructing them in their duty.

  • I know that I am going to get a lot of flack and name calling for this statement, but here it goes. In defense of these two officers, they are doing the job they are getting paid for. Most officers don't know the Constitution, they are only schooled in the parts that pertain to them. They are instructed in Miranda vs. Arizona for example. I am not saying that the police departments have a right to do this, the do not. But the individual officers are taught that this is acceptable behavior.

    - a police check point is legal as long as all vehicles passing through the check point are stopped.. but that's NOT what I see on this video..

    - a police officer is not supposed to stop you or search your car at any time without a probable cause/reasonable suspicion..

    - charges were false; Abby Newman clearly does NOT assault the police officer neither is she resisting arrest..

  • Generally, police can ask for proof that a person has a license to operate a motor vehicle if the officer has reasonable suspicion that a driving law violation has occurred. I see no proof of that in this video.

    So, a big question here is if the officer was giving a "lawful order". A lot of people are not convinced that his stop was legal, or his orders were lawful.

  • @DavidForthoffer Without reasonable suspicion to believe a crime has occurred, they can not make a stop. They allowed several cars, clearly seen in this video, to pass right through. Obviously they are not stopping "everyone", they are making arbitrary decisions as to who to stop and why without any reasonable suspicion of crime, as they admit in the video. SOME are legal (only because of judicial review, NOT because of law), this one is not legal. Thanks for being civil in this post ;-)

  • @ssn708: You are again mistaken. It is possible for police to set up legal checkpoints, where vehicles are stopped without any suspicion of criminal activity. It is not true that all vehicles be stopped. The main criterion is that vehicles be stopped without any discretion on the part of officers, such as by stopping every fifth vehicle.

    Read the U.S. Supreme Court case Michigan v. Sitz.

    It is NEVER lawful for an officer to deprive you of your constitutional rights, such as your right against unreasonable searches or seizures without a warrant.

  • So you are saying you must have an ID even when not driving? Then why are citizens not ask for ID who do not drive. The DMV does not know your exist till you apply for license.

  • That´s the way it is in germany. Here you MUST take you ID etc. with you just in case...and it does not matter wether you´re driving or taking a walk ^^ I don´t really know why but we must cause if a policeman asks you to show him your ID and you have no ID with you he could arrest you as far as I know. I´ll have to ask about that at my local policestation.

  • Yes, the police have the right to ask you for your ID any time. However, that does not give them the right to arrest you if you do not show ID.

    You are NOT required by law to carry your ID at all times once you're over the age of 16. In fact you are not even required to POSSESS an ID, unless you drive a vehicle, must file taxes, etc..

  • In Terry v. Ohio, the Supreme Court said, "an officer may not arrest a suspect for failure to identify himself if the identification request is not reasonably related to the circumstances justifying the stop".
